i <br /> 7. Appropriate Law Enforcement Agency: The attorney general of the State of Minnesota,the <br /> sheriff of each county in which a pawnbroker maintains an office, the police chief of the municipality <br /> or law enforcement officers of the municipality in which a pawnbroker maintains an office. <br /> SECTION 2 LICENSE REQUIREMENT <br /> Subd. 1. No person may engage in the business of a pawnbroker or otherwise portray the person as a <br /> pawnbroker, unless the person has a valid license authorizing engagement in the business. Any <br /> transaction made without the benefit of a license is void. <br /> Subd. 2. A separate license is required for each place of business. More than one license may be issued <br /> to a person if that person complies with this Ordinance and Minnesota Statute 325J for each license <br /> and location. <br /> Subd. 3. Each license shall remain in full force and effect until surrendered, suspended, revoked, or <br /> expired. A license may be suspended or revoked for failure to comply with this Ordinance or M.S. § <br /> 325J. <br /> Subd. 4. No expiration, revocation, suspension, or surrender of any license shall impair or effect the <br /> obligation of any preexisting lawful contract between the licensee or any pledgor. <br /> Subd. 5. The appropriate law enforcement agency shall be notified by the municipality of any licensee <br /> whose license has expired or been surrendered, suspended, or revoked as provided by this chapter. <br /> SECTION 3 LICENSE ELIGIBILITY <br /> Subd. 1. To be eligible for or to maintain a pawnbroker license, a person must operate lawfully and <br /> fairly within the purposes of this M.S.§ 325J and this Ordinance. No license under this Ordinance shall <br /> be issued to a person if: <br /> a) The person is a minor at the time the application if filed. <br /> b) The person may has been convicted of any crime directly related to the occupation <br /> licensed as prescribed by Section 354.03 W, subd. 2,unless the person has shown <br /> competent evidence of sufficient rehabilitation and present fitness to perform the duties of a licensee <br /> under thi-s Minnesota Chapter 325J,this Ordinance and as prescribed by Minnesota Statute 364.03, <br /> subd. 3. <br /> C) The person is not a citizen of the United States nor a resident alien. and <br /> of good moral character and repute. <br /> Subd. 2. Each license issued under this Ordinance shall be issued to the applicant only and shall not <br /> be transferred to any other person. No licensee shall loan, sell, give or in any other way convey, nor <br /> give permission for the use of, a license issued under this Ordinance to any other person. Any change, <br /> directly or beneficially, in ownership of any licensed pawnshop shall require the application for a new <br /> license and the new owner must satisfy all current eligibility requirements. <br /> Page 2 <br />
