Open Forum <br /> No one appeared for open forum <br /> 5. Planning and Zoning Report <br /> Planning and Zoning report received by Council. <br /> 5.1. Variance Request by Lakes State Bank for Signage <br /> Chuck Marohn indicated that Lakes State Bank is requesting a variance to erect <br /> a sign exceeding the maximum square footage allowed. Mr. Marohn indicated <br /> that the Planning Commission unanimously recommended that the Council deny <br /> the request based on six findings of fact. Mr. Marohn stated that he would work <br /> with Lakes State Bank to come up with a signage plan that will work for the bank. <br /> COUNCIL MEMBER SJOBLAD MOVED TO DENY THE SIGN VARIANCE <br /> REQUEST BY LAKES STATE BANK BASED ON THE SIX FINDINGS OF <br /> FACT LISTED IN THE ZONING ADMINISTRATOR'S REPORT DATED MARCH <br /> 28, 2005. COUNCIL MEMBER PFEIFFER SECONDED THE MOTION. MOTION <br /> CARRIED 7-0. <br /> 5.2. Conditional Permit for a Planned Unit Development, Wilderness Resort Villas, <br /> LLC <br /> Report presented by Chuck Marohn. Mr. Marohn indicated that the Planning <br /> Commission recommended approval based on several findings of fact listed in <br /> the Zoning Administrator's report dated March 28, 2005. <br /> Mayor Malecha informed the public that all letters and a-mails received on the <br /> matter have been forwarded to the Council and made part of the public record. <br /> Tom Fitzpatrick, Legal Counsel for the applicant, spoke on behalf of the <br /> applicant. Mr. Fitzpatrick indicated that the project as proposed met DNR <br /> standards for commercial development density and City ordinance standards. He <br /> indicated that the proposal was consistent with the comprehensive plan. Mr. <br /> Fitzpatrick also indicated that the resort is currently permitted 40 boat slips. He <br /> noted that the proposal does not exceed standards for a commercial PUD. Mr. <br /> Fitzpatrick urged the council to support the recommendations of the Planning <br /> Commission by approving the conditional use permit and the preliminary plat. <br /> Ron Moreim of the DNR indicated his concern regarding the proposal. He <br /> indicated that the DNR interprets the development as a residential proposal. He <br /> stated that he felt the mooring standards do not support DNR regulations. Mr. <br />
