Mr. Adams explained that the City had received a request from Ms. Watt's attorney to
table this public hearing to the December Planning Commission meeting.
A motion was made by Scott Pederson, seconded by John Derksen,to table this public
hearing to December. After discussion, Mr. Derksen withdrew his second and Mr.
Pederson withdrew his motion.
The Planning Commission discussed the Findings of Fact and decided to add the
following one: Representation of the applicant has failed to develop findings to support
his client's request to zone it commercial.
do
1
A motion was made by John Derksen, seconded by Mark H to recommend the City
Council rezone this parcel Rural Residential, based on the Findings of Fact:
1. The rezoning to Rural Residential is cons' th the Comprehensive
Plan and Future Land Use Map, wh designates this pr as a Rural
Residential.
2. The present land use tax classification of t ce or seasonal r , dential.
3. The landowner's stated desire to zone cel fo Commereial would be
inconsistent with the City's:Comprehensive and Future Land Use Map,
which designates this area as al Res, y' a. The partial commercial
zoning would also be considers of zoning, -ng this property owner
special privileges unafforded to hose oring l operties within the City
`.. \ .
boundaries. \\ \\`
4. Rezoning to C " "A X would be onsisten th the immediate surrounding
land use pa ' y Thi" - ,particularl he case, given the Future Land Use Map
designatio a pres zoning of e' ng adjacent properties.
5. The subject pro i e to pr 'erties that have been rezoned to Rural
Resi o the th ,, °€r,1 i "cross County Highway 112, and Forest
dge cen e west.
6.0 e propert y edi jacent to the south reflects an established
lopment pa of rur esidential housing. The larger property to the north
is " 'de of the lirrlrts, but also reflects a present land use pattern for
resid uses.
7. The pri „ fron a of this property is along County Highway 16 and all future
land use ons of parcels along this northern boundary thoroughfare of
City of Peq\\t Lakes are guided as Future Land Uses for Rural Residential,
Agriculture,'or Forestry Management. This reflects a major land use pattern of
both current and future use for this area of the City. Any change from pattern
would constitute a major departure from the City's current policy for land use in
this area and would require an extensive re-examination of its Comprehensive
Plan and a subsequent amendment thereto. Without such an initiative, this would
in fact be considered spot zoning.
8. The Rural Residential zone is compatible with the Agriculture, Forest
Management, Transitional Residential, and Recreation Zones.
Planning Commission Minutes 3
November 16, 2006
