City Council Meeting
January 11, 2006
Page 8
---------------------------
3. The proposed use has the potential to be injurious to the use
and enjoyment of existing residences in the area. All of the
residences are at least 500 feet from the project site, but associated
project noise from general operations has the potential to interfere
with the enjoyment of these nearby properties. The degree of
degradation would not be known until the site is fully developed and
operating.
4. The findings already listed indicate that the use, even with
conditions, would be injurious to the public health, safety, welfare,
decency, order, comfort, convenience, appearance or prosperity of
the City.
5. The application only indicates partial development of the site.
Impacts identified in these findings of fact would be accentuated
with full development of the site. Full site development is anticipated
by the applicant, as per the testimony of their representatives at the
November 17, 2005 public hearing.
6. There are other areas of the city where this type of
development currently exists. Those areas, and adjacent properties,
are generally better suited for extractive uses than the proposed site.
Denial of this proposal is based on the characteristics of the
proposed site and not a general opposition to extractive uses and
the associated accessory uses.
7. A hot mix plant, concrete plant, crushing, and washing is not
addressed in the City's ordinance and not recognized as a
conditional use.
COUNCIL MEMBER PFEIFFER SECONDED THE MOTION. MOTION
CARRIED 7-0.
Attorney Paul Sandelin indicated that he would incorporate all of the
Council's findings into a formal document.
The Council recessed at 8:35 p.m. and reconvened at 8:50 p.m.
3. Discussion on Trailside Estates
Discussion was held regarding the feasibility of the City assessing the
Trailside Estates Development project. Council Member Bolz-Andolshek
indicated that he met with the developer to discuss options to make the
development work. One of the issues is that the developer was suggesting
installing a private septic system and well for the development which
consists of 64 single family homes.
