Call Meeting to Order <br /> Mayor Malecha called the special meeting of the Pequot Lakes City <br /> Council to order at 6:00 p.m. <br /> 1.1 Pledge of Allegiance <br /> Mayor Malecha led with the Pledge of Allegiance <br /> 2. Anderson Brothers Appeal to Conditional Use Permit <br /> City Attorney Paul Sandelin noted that Anderson Brothers are appealing <br /> the denial of a conditional use permit application for a gravel pit which was <br /> denied by the Planning Commission on November 17,2005. Mr. Sandelin <br /> reviewed the procedure to be followed for the appeal hearing. He <br /> indicated that the appeal has been advertised as a public hearing. Mr. <br /> Sandelin indicated that the Planning Commission reviewed the items that <br /> must be met for a conditional use permit to be approved. He further noted <br /> that the Planning Commission based their decision on findings of fact that <br /> are listed in the Planning Commission minutes and that they have been <br /> distributed to the City Council. <br /> Ray Charpentier, attorney on behalf of the applicant, Anderson Brothers, <br /> spoke to the following issues: <br /> • The land is properly zoned <br /> • There is gravel on the land <br /> • The Planning Commission did not list the conditions that allow the <br /> gravel extraction use of the land <br /> Terry Curtis, Director of Business Development and Government <br /> Affairs for Anderson Brothers, reviewed the history of the application. <br /> He spoke about the phases of the proposal. Mr. Curtis indicated that they <br /> would voluntarily conduct an EAW on the entire 174 acres and would <br />
