City Council Minutes <br /> March 8, 2006 <br /> Page 6of11 <br /> ----------------------------- <br /> COUNCIL MEMBER BOLZ-ANDOLSHEK MOVED TO TABLE A <br /> DECISION ON THIS ISSUE AND TO SEND IT BACK TO PLANNING <br /> AND ZONING TO REVIEW THE ZONING IN THE ENTIRE AREA. <br /> COUNCIL MEMBER PFEIFFER SECONDED THE MOTION. MOTION <br /> CARRIED 5-0. <br /> 6.2. Rezoninq Request by Michael and Kelly McBrien <br /> Report by Dawn Bittner. Dawn noted that the Planning Commission <br /> reviewed this request and recommended that the property be rezoned to <br /> rural residential from the new ordinance classification based on ten <br /> findings of fact listed in Zoning Administrator's report to the Mayor and <br /> City Council dated February 20, 2006. <br /> COUNCIL MEMBER GREER MOVED TO ADOPT ORDINANCE 06-06 — <br /> AMENDING THE OFFICIAL ZONING MAP FOR THE MCBRIEN <br /> PROPERTY FROM RURAL RESIDENTIAL TO RURAL RESIDENTIAL. <br /> MOTION CARRIED 5-0. <br /> 6.3. Tax Forfeit Lots <br /> Dawn Bittner noted that the County has informed the city of four lots (Lots <br /> 16-19, Block 17 of Pequot Shady Shores) that are tax forfeit. Dawn noted <br /> that the Planning Commission reviewed the lots and has recommended <br /> that the Council notify the County that the City does not wish to have the <br /> lots sold. <br /> COUNCIL MEMBER RYAN MOVED THAT THE TAX FORFEIT LOTS <br /> NOT BE SOLD AND THAT THE CITY DOES NOT AGREE WITH THE <br /> NON-CONSERVATION STATUS OF THE LOTS. COUNCIL MEMBER <br /> PFEIFFER SECONDED THE MOTION. MOTION CARRIED 5-0. <br /> 6.4. MCBryde Violation <br /> Dawn Bittner noted that the McBryde property has been in violation of the <br /> Ordinance for storage of refuse since 2001. She indicated that the <br /> Planning Commission is recommending that the Council authorize <br /> prosecution of the property in order to resolve the violation. <br /> COUNCIL MEMBER BOLZ-ANDOLSHEK MOVED TO BEGIN <br /> PROSECUTION OF THE VIOLATION. COUNCIL MEMBER GREER <br /> SECONDED THE MOTION. MOTION CARRIED 5-0. <br />
