She also updated the Council on Mr. Smith's request to rezone <br /> the parcel of property from Transition Residential to Urban Residential. <br /> COUNCIL MEMBER RYAN MOVED TO RECONSIDER THE OCTOBER <br /> 20, 2005 COUNCIL MOTION REGARDING THE REZONING OF MR. <br /> SMITH'S PROPRTY. COUNCIL MEMBER GREER SECONDED THE <br /> MOTION. MOTION CARRIED 4-1. COUNCIL MEMBER PFEIFFER <br /> OPPOSED. <br /> The Clerk handed out two letters of opposition to the rezoning request <br /> from Mark Forsberg and Curt and Jackie Cogan. <br /> Mr. Smith updated the Council on his plat proposal. He noted that he is <br /> requesting that the property be zoned urban residential to allow 80 single <br /> family dwelling units. <br /> Council Member Greer indicated that a rezoning to urban residential would <br /> allow up to 181 units on the property. He noted that even though Mr. <br /> Smith is not proposing that many units, the property could be sold to <br /> another developer and this many units would be allowed. <br /> Dean Williams noted that the Planning Commission stands by its decision <br /> to have the property remain a transition residential zone. <br /> Earl Hemmerich spoke about his property being rezoned from multi-family <br /> to transition just after he decided to sell the property. He indicated that he <br /> has lost much money on his property due to the rezoning of his property. <br /> Planning Commissioner Pederson spoke about the zoning as it relates to <br /> the comprehensive plan. <br /> Council Member Bolz-Andolshek questioned whether the property was <br /> rural in nature. He further questioned where else the City could place a <br /> development like this that was close to city services. <br /> Planning Commissioner Habein indicated that the rezoning of property <br /> should not be a downgrade to the property as in the Hemmerich case. The <br /> property should become more valuable with a rezoning. <br /> Planning Commissioner Mark Hallan indicated that the Planning <br /> Commission could revisit the entire surrounding area in regard to the <br /> zoning. He noted that rezoning the Smith property to urban residential <br /> would affect surrounding property. <br />
