CITY OF PEQUOT LAKES ORDINANCE NUMBER 178 AN ORDINANCE RELATING TO THE STORM SEWER SYSTEM THE CITY COUNCIL OF THE CITY OF PEQUOT LAKES DOES ORDAIN: SECTION 1 - Storm Sewer Drainage Utility Subdivision 1 - E tablishra . A storm sewer drainage system for the City of Pequot Lakes is hereby established. The municipal storm sewer system shall be operated pursuant to M.S. Section 444.075 from which revenues will be derived subject to the provisions of this Chapter and said Minnesota statutes. The storm water drainage system shall operate under the management and direction of the Roads & Streets Department, subject to direction of the City Council. Just and reasonable charges for use and availability of storm sewer drainage facilities shall be calculated and determined pursuant to the terms hereinafter contained based on expected and typical storm water run off as may be calculated within reasonable and practical limits with due regard to just and equitable charges as provided for herein. �. Subdivision 2 - Definitions. Rates and charges for the use and availability of the utility system shall be determined through the use of a residential equivalent factor(REF), defined as the ratio of the average volume of run off generated by one acre of typical single family residential land,during a two (2)inch rainfall event. SECTION 2 - Storm Water Drainage Fees Subdivision 1 - Fees. For the purpose of calculating storm water drainage fees for parcels of land,the REF for the parcel's storm water land use classification shall be multiplied by that parcel's acreage, and then the resulting product shall be multiplied by the storm water drainage rate, or in formula format: Fee=REF x Acreage x Rate. The REF values for the various storm water land use classifications are as follows: CLASS STORM WATER LAND USE C'1 A SSIFIC'ATIONS REF 1• Vacant .20 2. Residential 1.0 3• Medium Density, Commercial, Industrial, Institutional 2.3 4• Heavy Density Commercial, Industrial& Institutional 4.0 For the purpose of calculating storm water drainage fees, actual acreage shall be used except for those parcels having a storm water land use classification of"Residential". As "Residential" r rcels are the most numerous, and to simplify the process, the storm water drainage ':.e for all parcels classified as "Residential"sh_ 11 ;e calculated using an acreav !'.333 ate. or 1/3, rega.dless of their actual acreage.
