AGENDA ITEM #12.1 <br /> REPORT TO <br /> CITY COUNCIL <br /> Date: February 7, 2006 <br /> Subiect: Storm Drainage Utility Fee <br /> Report: The Council has requested staff to look into the possibility of <br /> imposing the storm water utility drainage fee to the residents who were in <br /> Sibley Township. The City's Attorney has researched the process and feels <br /> that the City's ordinance would apply to all Pequot Lakes' property owners. <br /> Sandy.- from the research l ha ve done and other municipal ordinances l ha ve <br /> reviewed, our ordinance would apply to the entire City, which would include the <br /> annexed area. The City's ordinance is based upon Minnesota Statute Section <br /> 444.075 which provides the City with the authority to establish a storm sewer <br /> charge to be applied city wide. l would suggest that we clarify in the ordinance <br /> that it app lies city wide, including the new area of the City. L et me kno w if ha ve <br /> any other questions. In speaking with Tim about the ordinance l believe that the <br /> classifications for charges would remain the same although the city can certainly <br /> modify that if it desires. Thank you. Paul Sandelin <br /> Attached is Ordinance #178 and an amendment to that ordinance which <br /> clarifies the inclusion of Sibley Township residents. <br /> Tim Houle will be prepared to discuss this issue. <br /> Council Action Requested: Council direction to move forward with an <br /> amendment to our existing ordinance. <br />
