Rezoning to Open Space would not constitute spot zoning as the Open Space zone does not grant <br /> the landowner any privileges that are not available in the surrounding zoning districts, but rather <br /> restricts development privileges. <br /> 6. The rezoning request to Open Space is consistent with the condition placed on the Wilderness <br /> Point PUD application that this property be rezoned to Open Space. <br /> 2. Ordinance Amendment to Increase the Impervious Coverage Limits in the Light Industrial(LI) <br /> and Commercial(C)zones. <br /> There has been some discussion by the Planning Commission regarding whether the current <br /> impervious coverage limits for the Commercial and Industrial zones are too restrictive. The <br /> Ordinance currently sets the impervious coverage limit at 25% for both the Commercial the Light <br /> Industrial zones. <br /> At last month's regularly scheduled meeting, the Planning Commission discussed amending the <br /> Ordinance to increase impervious coverage limits to allow increases in impervious coverage in both <br /> the Commercial and Light Industrial zones. In the Commercial zone, an increase up to a total of 50% <br /> coverage would be allowed through the conditional use permitting process with an approved <br /> stormwater management plan for a 10-year stormwater event. In the Light Industrial zone, the base <br /> impervious coverage limit would be increased to 50%. An increase up to 90%would be permitted in <br /> areas where municipal storm sewer is available with a conditional use permit and increased <br /> vegetation placed within the setbacks. <br /> The Planning Commission is recommending that the Land Use Ordinance be amended as <br /> follows: <br /> Section 5.10, Subdivision 4A, containing performance standards for the Commercial zone, shall be <br /> amended to read as follows(changes indicated in bold, underlined text): <br /> A. Impervious Coverage. Impervious coverage may be increased by up to 25%, not to exceed <br /> 50%of the property,through a conditional use permit if the following information is provided <br /> and approved by the City: <br /> i. A stormwater retention plan showing containment of a 10-year, 24-hour storm event on the <br /> parcel. <br /> Section 5.13, Subdivision 3, containing the Lot, Use, and Density Requirements, shall be amended <br /> from 25%as the"Impervious surface—percent,maximum"number to 50%. <br /> Section 5.13, Subdivision 4A,containing performance standards for the Light Industrial zone,shall be <br /> amended to read as follows (changes indicated in underlined text): <br /> A. Impervious Coverage. Impervious coverage may be increased up to 90%through a conditional <br /> use permit on properties where municipal storm sewer is available if the following is <br /> provided: <br /> i. A vegetation plan for the perimeter of the property that increases vegetation within <br /> the setbacks. <br /> ii.
