b. Each member must pay a pro rata share of the association's expenses,and unpaid <br /> assessments can become liens on units or sites. <br /> c. Assessments must be adjustable to accommodate changing conditions. <br /> d. The association must be responsible for insurance,taxes, and maintenance of all <br /> commonly owned property and facilities. <br /> e. Changes to the owners'association must be approved by the City. <br /> In addition to the above Ordinance Language, Section 6.1, subpart 4 shall be amended to include <br /> "Recreational Vehicle Resort Overlay District" and an overlay district established by Section VI <br /> of the Ordinance. <br /> Finally, the Commission recommends adding"Recreational Vehicle Resort"to the land use <br /> matrix as a Conditional Use within the AG, FM, RR and REC zoning classifications, subject to <br /> the standards of the overlay district. <br /> Adoption of the Ordinance amendment requires a 4/5ths vote of the City Council. <br /> At the request of the Council and as per the Comprehensive Plan, the Planning Commission has <br /> discussed park dedication fees and has concluded that the City should continue to have a park <br /> dedication fee. The conclusion is based off of the following findings of fact: <br /> - The community lacks public park facilities, <br /> - The amount of lake access available to the public is becoming more limited and <br /> exclusive, <br /> - The percentage of the population is increasing, and increasing the demand on parks, <br /> - Lakes used to be available to the general public, but development has limited that <br /> availability, <br /> - The existing city park at Sibley Lake needs to be improved, <br /> - Potlatch property that has been accessible to the public is now being privatized, and <br /> the city needs to have funds to retain some of this land for public use, <br /> - As stated in the comprehensive plan, there is a desire by residents to protect the <br /> character of the community, which includes preservation of open space. <br /> The Planning Commission recommends that the Council direct the Park Board to develop criteria <br /> for application of park dedication fees. The criteria should give consideration to the differences <br /> between commercial and residential development. It should provide credit for conservation and <br /> open space and for other recreational facilities provided for on the property.
