WHEREAS, the City has determined to vacate that portion of Lind Street, Block Five, <br />�- Pequot Shady Shores legally described as follows (the "Subject Property" or "Street"): <br />That part of Lind Street, lying east of the northerly extension of the west line of Lot <br />15, Block 5, PEQUOT SHADY SHORES, according to the record plat thereof, <br />Crow Wing County, Minnesota. <br />WHEREAS, the proposed vacation would be in the interest of the public under Minn. <br />Stat. §412.851 as the proposed portion of Lind Street has never been opened to the public and <br />does not serve the purpose for which it was laid out in the Plat of Pequot Shady Shores and <br />provides limited if any access to the public water; and <br />WHEREAS, all members of the City Council voted in favor of this Resolution; and <br />NOW, THEREFORE, BE IT RESOLVED, that pursuant to Minnesota Statute Section <br />412.851: <br />l. That a portion of Lind Street within the plat of PEQUOT SHADY SHORES <br />legally described as follows is hereby vacated (the "Subject Property" or <br />"Street"): <br />That part of Lind Street, lying east of the northerly extension of the <br />west line of Lot 15, Block 5, PEQUOT SHADY SHORES, according <br />`. to the record plat thereof, Crow Wing County, Minnesota; and <br />� <br />2. As a result of said vacation, the fee interest in the following property is vested as <br />follows: <br />That part of Lind Street, lying east of the northerly extension of the <br />west line of Lot 15, Block 5, PEQUOT SHADY SHORES, according <br />to the record plat thereof, Crow Wing County, Minnesota. <br />is vested in the name of Mark E. Mortenson and Teresia A. Mortenson, husband <br />and wife, as joint tenants. <br />3. The City in its discretion has determined that as required by Minn. Stat. § 412.851 <br />the proposed road vacation is in the interest of the public as the proposed portion <br />of Lind Street to be vacated has never been opened to the public and does not <br />serve the purpose for which it was laid out in the Plat of Pequot Shady Shores and <br />provides limited if any access to the public water. <br />2 <br />
