05.01 - Lind Street Vacation Public Hearing

WHEREAS, the City has determined to vacate that portion of Lind Street, Block Five, �- Pequot Shady Shores legally described as follows (the "Subject Property" or "Street"): That part of Lind Street, lying east of the northerly extension of the west line of Lot 15, Block 5, PEQUOT SHADY SHORES, according to the record plat thereof, Crow Wing County, Minnesota. WHEREAS, the proposed vacation would be in the interest of the public under Minn. Stat. §412.851 as the proposed portion of Lind Street has never been opened to the public and does not serve the purpose for which it was laid out in the Plat of Pequot Shady Shores and provides limited if any access to the public water; and WHEREAS, all members of the City Council voted in favor of this Resolution; and NOW, THEREFORE, BE IT RESOLVED, that pursuant to Minnesota Statute Section 412.851: l. That a portion of Lind Street within the plat of PEQUOT SHADY SHORES legally described as follows is hereby vacated (the "Subject Property" or "Street"): That part of Lind Street, lying east of the northerly extension of the west line of Lot 15, Block 5, PEQUOT SHADY SHORES, according `. to the record plat thereof, Crow Wing County, Minnesota; and � 2. As a result of said vacation, the fee interest in the following property is vested as follows: That part of Lind Street, lying east of the northerly extension of the west line of Lot 15, Block 5, PEQUOT SHADY SHORES, according to the record plat thereof, Crow Wing County, Minnesota. is vested in the name of Mark E. Mortenson and Teresia A. Mortenson, husband and wife, as joint tenants. 3. The City in its discretion has determined that as required by Minn. Stat. § 412.851 the proposed road vacation is in the interest of the public as the proposed portion of Lind Street to be vacated has never been opened to the public and does not serve the purpose for which it was laid out in the Plat of Pequot Shady Shores and provides limited if any access to the public water. 2
