� <br />CITY OF PEQUOT LAKES <br />RESOLUTION NO. 12- <br />A RESOLUTION VACATING A PORTION OF LIND STREET <br />BLOCK FIVE <br />PEQUOT SHADY SHORES <br />CROW WING COUNTY <br />WHEREAS, a petition signed by a property owner, Mark E. Mortenson and Teresia A. <br />Mortenson, for property abutting Lind Street (a portion o� in Pequot Lakes was received by the <br />City Clerk on or about the 17th day of May, 2012 (the "Petition"); and <br />� WHEREAS, the Petition requested that the City of Pequot Lakes (the "City"), pursuant <br />to Minnesota Statute §412.851, vacate a portion of Lind Street legally described as: <br />� <br />That part of Lind Street, lying east of the northerly extension of the west line of Lot <br />15, Block 5, PEQUOT SHADY SHORES, according to the record plat thereof, <br />Crow Wing County, Minnesota; and <br />WHEREAS, the City Clerk reviewed and examined the signatures on said Petition and <br />determined that said signatures constituted a majority of the landowners abutting upon Lind <br />Street (portion o� to be vacated; and <br />WHEREAS, a public hearing was held on November 13, 2012 before the City Council in <br />the City Hall after due published and posted notice had been given by the City Clerk on October <br />29, 2012, including mailed notice to all property owners within the plat of PEQUOT SHADY <br />SHORES and adjoining properties and all interested persons were given an opportunity to be <br />heard at the City Council meeting; and <br />WHEREAS, a separate notice of the proposed road vacation was provided to the <br />Minnesota Department Natural Resources as required by Minn. Stat. §412.851 and the <br />Department of Natural Resources through a letter dated September 19, 2012 did not oppose the <br />Petition; and <br />1 <br />
