Spray Irrigation Field Rental Agreement <br /> For the past several years the City has entered into an agreement with Bill Tulenchik to <br /> rent the City's spray irrigation field. The agreement indicates that the tenant agrees to <br /> plant crops on the property. The tenant also agrees to certain stipulations in the agreement <br /> to ensure that the MPCA guidelines are met. <br /> Prior to 2004 the lease agreement was a seven-year agreement. The reason for the seven- <br /> year agreement was because the (tenant) invests several thousand dollars in the crops <br /> which takes many years to recover. <br /> In 2004 the Council requested staff to have the agreement drafted to run one year instead <br /> of seven years. I'm not sure what the Council's reasons were for this action. In 2005 the <br /> City received a request from an individual (not the current tenant)to submit a bid for <br /> harvesting the spray irrigation field. It was the City Council's motion not to request bids <br /> for the spray irrigation field, and to maintain the existing relationship with the current <br /> tenant. <br /> The City Attorney's opinion on this issue is that"there is no specific requirement for the <br /> City to advertise for bids for a real estate lease or to accept a higher bid." <br /> The reason this is before the Council again is because the City has received another call <br /> from the same person who is requesting to lease the property for crops. On the other <br /> hand,Mr. Tulenchik has indicated that he would like to go back to a longer lease period <br /> due to the amount of money invested in the crops and the time it takes to recover the <br /> investment. <br />
