3. Appeals of the decision of the Planning Commission regarding <br /> Conditional Use Permits and final plats. <br /> 4. Appeals of the decision of the Board of Adjustment for variances from this <br /> Ordinance. <br /> 5. To hear appeals from the actions of the Board of Adjustment and the <br /> Planning Commission where their action is normally final. <br /> In Section 11.9, regarding the Subdivision review process, amend Subdivision 6(C) and <br /> 6(D) as follows: <br /> C. The Planning Commission shall review the reports a ttorney, Engineer, <br /> Zoning Administrator, and independent Registered Surveyor and ast-make a <br /> recommendation to the City Council within the r e eframe. <br /> D. Bria 1, Shore a Alteration: <br /> Mr. P res Mr. Marohn explained the initial site visit, as well as the 5 <br /> conditions oval. Staff passed out pictures of the sensitive ice ridge taken <br /> before and a the shoreline alteration. He explained that they were not <br /> permitted to create a beach,just access to the dock. Mr. Marohn stated that a <br /> letter had been received from the Cullen Lakes Association. <br /> Mr. Pahl stated they had taken pictures during construction. When they found the <br /> rocks,they phoned Mr. Marohn's office. The rocks that are there now are the <br /> same rocks found in the ice ridge. Dock access was discussed. He stated they <br /> had placed a berm at the top of the slope to prevent storm water from the yard <br /> reaching the lake. The berm is hard to see in the pictures.
