i <br /> 8.7 Quiet Enjoyment: Interference Prohibited. All Owners and Occupants <br /> shall use the Development in such a manner as will not cause a nuisance, nor unduly <br /> restrict, interfere with or impede the use of the Development by other Owners and <br /> Occupants and their guests. No substance, thing, or material may be kept on any part <br /> of the Development if that material emits foul or obnoxious odors, or will cause any <br /> noise that will or might disturb the peace, quiet, comfort, or serenity of neighbors. Lot <br /> Owners, Occupants or guests shall not make noises, play instruments, or operate <br /> radios, televisions or amplifiers in a way that disturbs other residents of the <br /> Development. Except during the initial construction of a Dwelling, equipment, tools, <br /> machinery and building materials shall be stored in a building or other location where it <br /> will not be seen from adjacent property. <br /> 8.8 Animals. No livestock, poultry, or animal of any kind shall be raised, bred, <br /> or kept on any Lot for commercial purposes. No wild or exotic animals shall be <br /> permitted on any Lot. No more than a combination of four(4)domesticated dogs, cats <br /> or other household pets shall be permitted on any Lot. No pit bull terrier, rottweiler, or <br /> other animal with a history of dangerous activity shall be allowed on any Lot. No pet <br /> shall be permitted outside of the Owner's Lot unattended by the Owner or the Owner's <br /> agent, and all pets shall be confined to the Owner's Lot in such a manner as not to <br /> disturb the lawful and peaceful use of adjoining Lots or to become a nuisance or threat <br /> to the safety of others. Barking dogs that become a nuisance or any animals <br /> considered to be exotic, vicious, dangerous, or which are noisy or which may constitute <br /> a nuisance shall be removed. Any cat, dog, or other animal whenever outside of a Lot, <br /> shall be kept on a leash or other such device under the direct control of the pet owner <br /> or another person able to control the pet. The person in charge of the pet must clean <br /> up after the pet. Owners and Occupants shall be liable for the cost of repair of any <br /> damage to the Development or any personal injury caused by animals kept by them. All <br /> applicable Governmental Regulations relating to the keeping of animals must also be <br /> complied with by Owners and Occupants of the Development. The Association may <br /> adopt Rules and Regulations regulating animals or prohibiting or removing animals <br /> which engage in dangerous or disturbing behavior. <br /> 8.9 Kennels. Any private enclosed area for the personal pets of a Lot owner <br /> or occupant or outdoor enclosure designed for confinement of a pet or animal <br /> ("Kennel")shall be located on the Lot only as approved by the Association, and each <br /> Kennel must be at least ten (10) feet from the side lot line. Kennels shall have opaque <br /> screening on all sides facing adjoining Lots. No Kennel or other animal enclosure shall <br /> be located in the front lot area or be greater than eighty(80) square feet of enclosed <br /> area. <br /> 8.10 Compliance with Law.
