`.. Declaration. In any event, all lawn maintenance and snow removal costs <br /> relating to individual Lots will be assessed only to those Lots requesting <br /> such services. <br /> b. The Association may provide trash removal (and recycling)for all <br /> individual Lots and may require that all Lots participate in the Association <br /> trash removal program. If the Association provides for trash removal, <br /> such costs will be assessed to Lot Owners in accord with Article 6 of this <br /> Declaration. In the event that the Association takes responsibility for trash <br /> collection, the Association shall determine a standard container size. <br /> C. The Association may with the approval of a majority of Owners cast in <br /> person or by proxy at a meeting called for such purposes, undertake to <br /> provide additional services or maintenance except for maintenance and <br /> upkeep of residential Dwellings. However, the Association may make <br /> such maintenance, repairs or replacements if the Association determines <br /> in its sole discretion that such work is necessary to prevent damage to the <br /> Common Elements or other property owned by the Association or others. <br /> The Association may also make such repairs in its discretion upon the <br /> written request of the affected Lot Owner, and all such costs shall be <br /> assessed against the Lot as provided in this Declaration. <br /> 7.3 Owners' Maintenance. Except as this Article otherwise provides, all <br /> `.. maintenance, repair or replacement of the Dwellings and Lots, including lawncare, <br /> shrub and tree maintenance and watering, and snow removal from driveways and <br /> sidewalks, shall be the sole expense and responsibility of the individual Lot Owners. <br /> Owners and Occupants shall have a duty to promptly notify the Association of any <br /> defects in or damage to the Common Elements or the Street Lights. The Association <br /> may require that any exterior maintenance to be performed by the Owner be <br /> accomplished pursuant to specific uniform criteria and standards the Association <br /> establishes. <br /> ARTICLE 8 <br /> RESTRICTIONS ON DEVELOPMENT'S USE AND OPERATIONS <br /> All Owners and Occupants, and ail parties, by their acceptance or assertion of an <br /> Interest in the Development, or by their ownership or occupancy of a Lot, covenant and <br /> agree that, in addition to any other restrictions which may be imposed by the Governing <br /> Documents, the ownership, occupancy, use, operation, alienation and conveyance of <br /> any Lot shall be subject to the restrictions set out in this Section. <br /> 8.1 General. The Development and all Lots shall be owned, conveyed, <br /> encumbered, leased, used and occupied subject to the Governing Documents.
