the purposes of maintenance, repair, replacement and reconstruction work necessary
<br /> to fulfill the Association's obligations under the Governing Documents.
<br /> 2.4 Use and Enjoyment Easements. Each Lot shall be the beneficiary of an
<br /> appurtenant easement for use and enjoyment on and across the Common Elements
<br /> subject to any restrictions provided in the Governing Documents.
<br /> 2.5 Utility and Drainage Easements. There shall be utility and drainage
<br /> easements in favor of any public authority or agency, or public or private provider, for
<br /> the installation, maintenance, repair, replacement and operation of water, sanitary
<br /> sewer, storm sewers, drainage systems, storm water retention ponds and related
<br /> facilities, and electrical, gas, telephone and other utility lines on, under and across the
<br /> Development and each Lot as shown on the Plat or described in other recorded
<br /> easements or instruments. No Dwelling, structure or other improvement shall be
<br /> erected or maintained, nor shall any fill or other material be placed in the easement
<br /> areas, which may damage or interfere with the installation or maintenance of such
<br /> utilities, or which may change the direction or impede the flow of water over any
<br /> drainage easements.
<br /> 2.6 Easement for Communications Services. The Development and each Lot
<br /> shall be subject to non-exclusive easements in favor of authorized providers of cable
<br /> television and other communications services on, under and across the Development
<br /> and utility easement areas shown on the Plat(s) or described in other recorded
<br /> easements or instruments for the purpose of installing, replacing, repairing, maintaining
<br /> and using television, cable, security, communications, Internet and similar systems.
<br /> Persons exercising these easement rights shall promptly repair any damage caused
<br /> during the exercise of such rights.
<br /> 2.7 Easements for Street Lights. The Developer expressly establishes, in
<br /> favor of the Association, a perpetual, non-exclusive, non-revocable, commercial
<br /> easement in gross in, over, under, upon and across the Common Elements within the
<br /> Development(including without limitation the private roads and streets)for the
<br /> purposes of location, construction, reconstruction, replacement, removal, maintenance,
<br /> use, repair and operation of the Street Lights, including all activities related and
<br /> incidental thereto,with respect to any part or portion of the Street Lights located within
<br /> the Development. Permitted uses within this easement include, without limitation,
<br /> ingress and egress for pedestrians, vehicles and construction equipment.
<br /> 2.8 Public Health and Safety Easements. There shall be non-exclusive
<br /> easements in favor of applicable governmental authorities upon and across the
<br /> Development for reasonable access to perform such duties related to law enforcement,
<br /> fire protection, life safety, health and sanitation as reasonably required from time to
<br /> time.
