operation, including without limitation allocations to reserves and those <br /> items specifically identified as Common Expenses in the Governing <br /> Documents. <br /> 1.7 "Developer" means Trailside Estates Development, LLLP, a Minnesota <br /> limited liability limited partnership, and its successors or assigns. <br /> 1.8 "Developer Control" means the period of time that Developer controls the <br /> Association's operation as provided in this Declaration. ! <br /> 1.9 "Development" means all of the real property subject to this Declaration, <br /> including the Dwellings and all other structures and improvements located <br /> thereon now or in the future. The Development as of the date of this <br /> Declaration is legally described on the attached Exhibit A. <br /> 1.10 "Dwelling" means a building consisting of one or more floors, designed <br /> and intended for occupancy as a single-family residence, and located <br /> within the boundaries of a Lot. The Dwelling includes any garage <br /> attached or otherwise located within the boundaries of the Lot on which <br /> the Dwelling is located. <br /> 1.11 "Governing Documents" means this Declaration, the Association's Articles <br /> of Incorporation, and its Bylaws, as they may be amended, all of which <br /> shall govern the Development's use and operation. <br /> 1.12 "Government Regulations" means all federal, state, county, township or <br /> municipal laws, rules, ordinances, regulations, directives, orders and <br /> requirements, including but not limited to the ordinances and regulations <br /> of Crow Wing County, now in force or which may later be in force <br /> applicable to the Development. <br /> 1.13 "Lot" means any platted lot subject to this Declaration as shown on the <br /> Plat, including all improvements thereon. Each Lot will be identified by its <br /> lot and block number as shown on the Plat. Lots will include those added <br /> as part of the Additional Real Estate. <br /> 1.14 "Member" means all persons who are members of the Association by <br /> virtue of being Owners. The words "Owner" and "Member" may be used <br /> interchangeably. <br /> 1.15 "Occupant" means any Person or Persons, other than an Owner, in <br /> possession of a Lot or residing in a Dwelling. <br /> 1.16 "Owner" means a Person who owns a Lot, excluding contract for deed <br /> vendors, guests, lessees, mortgagees and other secured parties.
