DECLARATION OF DEVELOPMENT <br /> STANDARDS AND COVENANTS <br /> (TRAILSIDE ESTATES) j <br /> Trailside Estates Development, LLLP, a Minnesota limited liability limited <br /> partnership (the "Developer") makes this Declaration of Development Standards and <br /> Covenants (this "Declaration") effective as of , 2006. <br /> RECITALS <br /> A. Developer owns real property located in Crow Wing County, Minnesota, <br /> legally described on the attached Exhibit A together with all appurtenant <br /> easements and improvements on the property(the "Development"). <br /> B. Developer is developing the Development into a residential community <br /> consisting of single-family residential lots containing detached homes. <br /> C. Developer desires to subject the Development and any Additional Real <br /> Estate to this Declaration's covenants and restrictions to ensure and <br /> preserve the Development's value, structural quality, and architectural and <br /> aesthetic character and to provide for the maintenance of certain common <br /> elements on the Development. <br /> D. Developer has formed Trailside Estates Homeowners Association, a <br /> Minnesota non-profit corporation ("Association")which will manage and <br /> maintain the Development's integrity, administer and enforce this <br /> Declaration's covenants and restrictions and collect and disburse any <br /> assessments and charges created in this Declaration. <br /> E.
