Recently, Mr. Couture questioned the city as to the status of his platting application. The records <br /> indicate from the September 2004 Planning Commission meeting that the matter was temporarily <br /> tabled for Mr. Couture to address several items of concern, of which some were the access point <br /> from State Trunk Highway Number 371 approved by MnDOT, grading and storm water plans, <br /> road plans and grades, etc. Mr. Couture was still in the process of developing these plans and <br /> provided the 60-day waiver at that meeting, and he believed his project and application was still <br /> active. He was surprised,then, to hear at the June 15th meeting that the City Planner and some <br /> commission members thought he had verbally withdrawn the application at the 2004 planning <br /> meeting when there is no documentation supporting that claim. He does not recall ever . <br /> requesting or agreeing to withdraw the project. In that regard, Mr. Couture questions how the <br /> city could rezone a property to a district with greater restrictions when an application existed on <br /> said property and there was no documentation indicating that the application was not active. <br /> Mr. Couture believes he has vested rights in his property on highway 371 based on the <br /> commercial zoning the property had when he purchased it and based on the active application for <br /> subdivision that was submitted in 2004 and temporarily tabled by the Planning Commission <br /> pending additional information. He would like the city,through its attorney, to research and <br /> respond to this matter accordingly. <br /> I trust this summarizes the questions and concerns discussed at the June 15, 2006 Planning <br /> Commission meeting and that as part of the minutes, you will direct this letter to the city attorney <br /> for his comment and direction to the Planning Commission so that Mr. Couture can continue to <br /> make progress in developing his property as intended. <br /> Mr. Couture appreciates the efforts made by the Planning Commission and city in reviewing his <br /> application and he looks forward to the direction the city will provide. <br /> Sincerely, <br /> LANDECKER&ASSOCIATES, INC. <br /> David S.
