The Ordinance further states,in Section 7.13, Grading, subpart 2.1)that "Fill is stabilized to acceptable engineering standards and must not create an unstable slope." The side slopes of the excavated area were not stabilized. The Ordinance further states,in Section 7.9, Vegetation Removal, subpart LA that "No vegetation shall be removed along the shoreline, within shore impact zones, on steep slopes and within bluff impact zones, except in conjunction with an approved site preparation or land alteration permit to accommodate the placement of stairways, landings, access paths, or authorized shoreland alterations" No site preparation permit was applied for or issued for work done on this property. This is a serious matter which we expect you to take immediate action to address. Upon receipt of this notice of violation, you must do the following: 1. Immediately cease and desist all further grading activities. 2. Immediately take steps to stabilize disturbed areas. At a minimum this will include temporary ground cover including mulch 3. Within ten days, submit an after-the-fact permit application detailing the extent of alteration. Once we have received your after-the-fact application, we will need to work on a resolution to this matter. As part of resolving this violation, at a minimum we will seek to have the shore impact zone restored. As per the City of Pequot Lakes Land Use and Subdivision Ordinance, until this matter is resolved,both you and the contractor who performed this illegal work on your behalf are barred from pulling any land use permits or doing any work requiring City of Pequot Lakes' approval.
