The Ordinance further states,in Section 7.13, Grading, subpart 2.1)that "Fill is stabilized <br /> to acceptable engineering standards and must not create an unstable slope." The side <br /> slopes of the excavated area were not stabilized. <br /> The Ordinance further states,in Section 7.9, Vegetation Removal, subpart LA that "No <br /> vegetation shall be removed along the shoreline, within shore impact zones, on steep <br /> slopes and within bluff impact zones, except in conjunction with an approved site <br /> preparation or land alteration permit to accommodate the placement of stairways, <br /> landings, access paths, or authorized shoreland alterations" No site preparation <br /> permit was applied for or issued for work done on this property. <br /> This is a serious matter which we expect you to take immediate action to address. <br /> Upon receipt of this notice of violation, you must do the following: <br /> 1. Immediately cease and desist all further grading activities. <br /> 2. Immediately take steps to stabilize disturbed areas. At a minimum this will <br /> include temporary ground cover including mulch <br /> 3. Within ten days, submit an after-the-fact permit application detailing the extent of <br /> alteration. <br /> Once we have received your after-the-fact application, we will need to work on a <br /> resolution to this matter. As part of resolving this violation, at a minimum we will seek <br /> to have the shore impact zone restored. <br /> As per the City of Pequot Lakes Land Use and Subdivision Ordinance, until this matter is <br /> resolved,both you and the contractor who performed this illegal work on your behalf are <br /> barred from pulling any land use permits or doing any work requiring City of Pequot <br /> Lakes' approval. <br /> We will look for your after-the-fact permit application.
