E. <br /> Otsego, MN 55330 <br /> Re: City of Pequot Lakes <br /> Notice of Violation <br /> PIN: 29117000010A009 <br /> 27623 County Road 107 <br /> Dear Mr. Lopez and Ms. Hauck: <br /> We are writing today to follow up on our site visit yesterday. At that time we observed <br /> and photographed extensive shoreline alterations done on your property within the City <br /> of Pequot Lakes. These alterations were done without any type of permit and are in <br /> violation of the Pequot Lakes Subdivision and Land Use Ordinance. <br /> The Ordinance states, in Section 7.13, Grading, subpart 1,that "The following activities <br /> must be authorized by permit. . : A. Grading and filling in the shore or bluff impact <br /> zone. D. Any alterations of the natural topography when the slope of the land is toward <br /> a public water or watercourse involving the movement of more than 10 cubic yards of <br /> material in a bluff or shore impact zone or more than 50 cubic yards of material <br /> anywhere else within a shoreland area. " No permit was applied for or issued for <br /> work done on this property. The excavation had been completed. <br /> The Ordinance further states, in Section 7.13, Grading, subpart 2.A that "The smallest <br /> amount of bare ground is exposed for as short a time as feasible." The excavation site <br /> was left with no erosion control in place. <br /> The Ordinance further states, in Section 7.13, Grading, subpart 2.0 that "Methods to <br /> prevent erosion and trap sediment are employed. " The excavation site was left with no <br /> erosion control in place. <br />
