Crow Wing County Zoning Ordinance <br /> Part III—Development Standards <br /> ARTICLE 37 <br /> SEWAGE TREATMENT FACILITIES <br /> TECHNICAL STANDARDS AND CRITERIA <br /> 37.1 SCOPE <br /> This Article shall regulate the location,design,installation,use,inspection,and maintenance of <br /> individual sewage treatment systems in all areas of Crow Wing County,other than cities and <br /> towns that have adopted ordinances that comply with Minnesota Statute 115.55 and are as strict <br /> as this Article.This chapter is authorized under Minnesota Statute Section 115.55 and 115.56 and <br /> Minnesota Statutes Chapter 145. <br /> 37.2 PURPOSE AND INTENT <br /> The purpose of this Article is to protect public health and safety of the residents of the county. To <br /> regulate the location,design,installation,use and maintenance of individual sewage treatment <br /> systems as to prevent contamination of the surface and ground waters of the county. To protect <br /> individual water supply wells of the community from contamination by inadequate,improperly <br /> designed,located,installed or maintained individual sewage treatment systems. Provide for the <br /> orderly development of areas in the community which are not served by central public waste <br /> treatment systems and to reduce the need to install central public systems in areas where they are <br /> not now currently planned. <br /> 37.3 ADOPTION OF TECHNICAL STANDARDS <br /> A. Minnesota Chapter 7080 is hereby adopted by reference in its entirety along with any future <br /> amendments adopted after June 2,2005. <br /> B. Minnesota Rules,part 7080.0179 is incorporated by reference into Ordinance Article 37- <br /> Sewage Treatment Facilities—Technical Standards and Criteria <br /> 37.4 WASTEWATER TREATMENT <br /> A construction permit from the Crow Wing County Planning and Zoning Office is required <br /> whenever any septic system is installed,altered,replaced,or extended. This Article of the Crow <br /> Wing County Zoning Ordinance may have additioinal requirements that shall to be followed. <br /> 37.5 STANDARDS AND CRITERIA THAT ARE MORE RESTRICTIVE THAN <br /> MINNESOTA CHAPTER 7080. <br /> A. No zoning,conditional use permit or variance will be issued,without a valid Certificate of <br /> Compliance or Certificate of Installation. <br /> B. Performance designs and installations shall require administrative approval. <br /> C. At least one cleanout at or above finished grade shall be installed between the structure and <br /> the septic tank with additional clean outs at intervals not more than one hundred(100)feet. <br /> D. Holding tanks shall not be allowed as an alternative system on any real properties created in <br /> Crow Wing County after January 4, 1997,except for the purpose to fix an existing failed <br /> system. Holding tanks shall not be allowed on properties pre-existing January 4, 1997 for the <br /> purpose of residential expansion or guesthouse additions or conversion of the property to <br /> other septic dependent use. <br /> E. Holding tank pumping receipt. All owners of new and existing holding tanks must submit <br /> pumping receipts upon request of the Planning and Zoning office. <br /> F. Site address. Septic designs shall have a site address or driving directions as part of the <br /> approval process. <br /> G. Type 1 sizing. Type 1 sizing is required on all new construction.New construction will be <br /> defined as new septic dependent structures. <br /> H. Variance request identified: The site design must include whether or not a variance will be <br /> required for the septic system. <br /> Part III Page 60 <br /> 9 <br />
