The Ordinance states, in Section 17-11.8, subpart 1, LAND USE PERMITS, states that "Land Use Permits shall be issued for all new structures. . . No person shall. . . construct any structure prior to applying for and receiving a Land Use permit. " The Ordinance further states, in Section 17-5.8, subpart 3, SHORELINE RESIDENTIAL, Lot,Use and Density Requirements,that "Setback, OHW—feet, minimum: 75". I have been to your property and taken the enclosed picture. If this picture accurately depicts your property, I would have to find that you are in violation of these provisions of the Ordinance. I have enclosed a Land Use Permit Application form Please complete the application and return to me no later than September 19,2008, including all items highlighted on page 1. Please indicate on the site plan the proposed location of the storage building outside the 75-foot setback from the OHW(Ordinary High Water Mark). The after-the- fact fee will be determined by the Planning Commission after receiving the application and supporting information.
