The property is zoned
Downtown Mixed Use and is 16,500 square feet. The applicant is proposing to split it
into two tracts, Tract A and Tract B. Proposed Tract A is 7,500 square feet with 5,699
square feet defined as buildable area. Proposed Tract B is 9,00o square feet.
F
Q ]Yd1M01
aamn
aoz om oms.+.b+ zsmcaoo i` 'm'S'wowiam zwcaaowms ' rnaaoawmoe
e
Tract A will contain a dwelling unit and Tract B will contain a detached accessory
structure should the lot split be approved. The applicants have already applied and been
approved to construct a 26'x 70'duplex on the property should the lot split be approved.
Tract A will have access off of Old Highway 371 and Tract B will have access of Gravdahl
Drive. Upon transfer of property Tract A will need to reserve a general easement across
Tract B for continued use of sanitary sewer connection.
Tim Houle, the City Engineer, has reviewed this and has stated the following concerns:
- Does the sanitary sewer main line running north-south through the proposed
Tract B have a written, recorded easement? I have not searched at all, but I
am not aware of one. I have understood, due to its longevity,it is pretty much
there by adverse possession/prescriptive easement (whatever the correct
term is).
- Does the presence of the sanitary sewer main line in the proposed Tract B
make it unbuildable? If this was a new line(although it is not),we would most
Pequot Lakes Staff Report 7(a)-1
September 18,2008
