The property is zoned <br /> Downtown Mixed Use and is 16,500 square feet. The applicant is proposing to split it <br /> into two tracts, Tract A and Tract B. Proposed Tract A is 7,500 square feet with 5,699 <br /> square feet defined as buildable area. The applicants have already applied and been <br /> approved to construct a 26'x 70'duplex on the property should the lot split be approved. <br /> Tract A will have access off of Old Highway 371 and Tract B will have access of Gravdahl <br /> Drive. Upon transfer of property Tract A will need to reserve a general easement across <br /> Tract B for continued use of sanitary sewer connection. <br /> Tim Houle,the City Engineer,has reviewed this and has stated the following concerns: <br /> - Does the sanitary sewer main line running north-south through the proposed <br /> Tract B have a written, recorded easement? I have not searched at all, but I <br /> am not aware of one. I have understood, due to its longevity,it is pretty much <br /> there by adverse possession/prescriptive easement (whatever the correct <br /> term is). <br /> - Does the presence of the sanitary sewer main line in the proposed Tract B <br /> make it unbuildable?If this was a new line(although it is not),we would most <br /> Pequot Lakes Staff Report 7(a)-1 <br /> September 18,2008 <br />
