COMMUNITY GRQWTH ` Gl of <br /> i N S T I T U T E <br /> Kvt rls in Sonall Town Planning <br /> vii. Restore and preserve all areas within a designated bluff. <br /> viii. Preserve all wetlands and all areas within 50 feet of a delineated <br /> wetland. <br /> ix. Provide screening between units 7, 8 41, and 45 and the adjacent <br /> residential property. <br /> x. Provide screening between the proposed storage units and the <br /> adjacent residential and DNR owned property. <br /> The plan must designate specie type and density. The plan must also <br /> specify an implementation schedule. <br /> b. The vegetation enhancement plan shall be reviewed by the Planning <br /> Commission. The plan will be revised as directed by the Planning <br /> Commission. <br /> c. Following review and revision as directed by the Planning Commission, <br /> the vegetation enhancement plan shall be accepted by the Planning <br /> Commission and then become a controlling document for the <br /> development. <br /> 19. As part of the final plat application, common space shall be rezoned to provide <br /> for the continued operation of the resort and the maintenance of open space. <br /> Section 11.9, Subdivision 6C outlines the procedure to follow when reviewing a final plat <br /> application and directs the Planning Commission to consider the following: <br /> 1. Has the applicant complied with all conditions and requirements upon which the <br /> preliminary approval is expressly conditioned wither through performance or <br /> execution of appropriate agreements assuring performance? <br /> 2. Does the Final Plat or Final Condominium Plat agree with the Preliminary Plat or <br /> Preliminary Condominium Plat? <br /> 3. Does the City Attorney agree that all parties with an interest in the property are <br /> shown as signers of the document? <br /> 4. Does the City Engineer agree that all improvements required are satisfactorily <br /> completed or are guaranteed by contract with adequate financial security? <br /> 5. Does an independent Professional Land Surveyor agree that the final document <br /> meets the statutory requirements? <br /> 6. Has financial security been posted in the appropriate amount? <br /> Staff Findings: Staff provides the following findings of fact for consideration by the <br /> Planning Commission: <br /> 1. The City Engineer has reviewed the erosion control plan. The erosion control <br /> plan is regulated through a State General Permit and there are no City <br /> requirements that would usurp these State requirements. The Engineer has not <br /> stated any concerns. <br /> 2. The City Engineer has reviewed the stormwater management plan. The <br /> stormwater management facilities are not going to be constructed or maintained <br /> by the City. The Engineer stated the stormwater management plan does direct <br /> runoff from their property into infiltration basins greatly minimizing, if not <br /> eliminating in many cases,any runoff that may leave their property or get directly <br /> into the lake and it is to his satisfaction. <br /> 3. The City Attorney has reviewed the rental contract and association contracts. Mr. <br /> Sandelin has stated the documents establishing the shared villas, garage <br /> association, and the amended declaration to the initial Wilderness Resort Villas <br /> Pequot Lakes Staff Report 3(a)-3 <br /> June l%2oo8 <br />
