Columbia Heights, MN 55421 Re: City of Pequot Lakes Ordinance Violation Cease and Desist Order PIN: 290271201A00009 Dear Mr. and Mrs. Peterson: You are hereby ordered to Cease and Desist all grading, dirt moving, tree and vegetation removal at the above-captioned property. I have been to your property and taken the enclosed pictures. These pictures clearly indicate that a Forest Land Conversion has taken place. The Ordinance defines a Forest Land Conversion as "The clear cutting of forested lands to prepare for a new land use other than the re-establishment of a subsequent forest stand. " A Forest Land Conversion is an excluded use in the Shoreline Residential zoning im Further, the Ordinance defines Grading as "The movement of dirt, by mechanical means, so as to alter the existing topography of a property. " Grading of 100 cubic yards or more outside of the lake setback requires a Conditional Use Permit. The Ordinance further states, in Section 17-7.12, Erosion, that, "Erosion control measures shall be provided in all areas disturbed during any grading or construction ... " This is a serious matter which we expect you to take immediate action to address. Upon receipt of this notice of violation, you must do the following: 1. Immediately cease and desist all grading and dirt moving activities. 2. Immediately cease and desist any further tree or vegetation removal. 3. Immediately place appropriate erosion control devices in place.
