Minnesota Pollution Control Agency <br /> Q Brainerd Office <br /> August 7, 2008 <br /> Mr. Gary Peterson and Mrs. Jaculin Peterson <br /> 3712 Lincoln Street Northeast <br /> Columbia Heights, MN 55421 <br /> RE: National Pollution Discharge Elimination System/State Disposal System Permit Requirements for <br /> Construction Activity Associated with Project Located on County Road 168 in the City of <br /> Pequot Lakes, Minnesota. <br /> Dear Mr. and Mrs. Peterson: <br /> On May 28, 2008, Crow Wing Soil and Water Conservation District(SWCD) staff, in partnership with <br /> the Minnesota Pollution Control Agency(MPCA)conducted an inspection of Gary and Jaculin Peterson <br /> (Regulated Party)and identified certain alleged violations of Minnesota Rules and Permit Requirements <br /> at your site located approximately 1/4 mile west of State Highway 371 on County Road 168 (Site). The <br /> following are descriptions of the activities that were documented by SWCD staff that are alleged to be in <br /> violation: <br /> 1. Minn. R. 7090.2010, CONSTRUCTION ACTIVITY PERMIT REQUIREMENTS. <br /> Subpart 1. Permits required. A NPDES/SDS construction stormwater permit is required if. <br /> A. A person is conducting construction activity; <br /> Minn. R. 7090.2010, CONSTRUCTION ACTIVITY PERMIT REQUIREMENTS. <br /> Subpart. 2. Permit application deadline. <br /> A. Owners and operators proposing activities that require a construction stormwater <br /> permit under this part must submit a complete permit application provided by the <br /> agency before conducting construction activity, or where a construction site is <br /> covered under an existing construction stormwater permit, meet the subdivision <br /> registration requirements under part 7090.2060, if applicable. <br /> During an inspection performed on May 28, 2008, Crow Wing SWCD staff observed and documented <br /> that land disturbing activity for the purposes of creating a road and open area resulted in the removal of a <br /> wide expanse of vegetation approximately 600 feet x 300 feet(approximately 180,000 square feet) in size <br /> located on County Road 168 (NE 'A of Section 27, T136N, R29W)within the city of Pequot Lakes, <br /> Minnesota.
