All members voted"aye". Motion carried. <br /> APPLICANT: City of Pequot Lakes <br /> Applicant requests to rezone from Residential to Shoreline Residential. Donald <br /> O'Brien, property owner. Parcel No.: 29121000003A009,291210000040009, <br /> 291210000050009 and 2912100000611009. <br /> The property owners were not in attendance. Mr. Marohn explained the Staff Report. <br /> There was no public comment. <br /> A motion was made by John Derksen, seconded by Tom Adams,to recommend rezoning <br /> these parcels to Shoreline Residential, based on the following Findings of Fact: <br /> 1. The rezoning to Shoreline Residential is consistent with the City's <br /> Comprehensive Plan as the properties are adjacent to shoreline and are residential <br /> in character. <br /> 2. The proposed rezoning to Shoreline Residential is mostly consistent with the <br /> Future Land Use Map, which designates the area adjacent to the shore as <br /> Shoreline Residential. The Future Land Use Map also designates the off-lake <br /> portions of these properties as Forest Management due to the forest cover in this <br /> portion of the City. <br /> `-- 3. The proposed rezoning to Shoreline Residential meets the compatibility <br /> requirements in that the properties are adjacent to the Water Resource zone; the <br /> compatibility requirements state that the zone should extend through the first tier <br /> of parcels to a public road or 500 feet from the OHW, whichever is closer to the <br /> water body. In this case, the public road to the south varies from being 500 feet to <br /> over 800 feet from the OHW. A rezoning of a portion of these properties to Forest <br /> Management would not meet the minimum lot size and dimension standards for <br /> that zoning district. <br /> 4. The subject property meets the purpose and intent of the Shoreline Residential <br /> district: to provide a district for riparian residential development. <br /> 5. The property meets the minimum lot size requirement of 20,000 square feet for <br /> the Shoreline Residential zone, with each property being more than 40,000 square <br /> feet in size or greater. <br /> 6. Three of the properties meet the minimum lot width standard of 100 feet for the <br /> Shoreline Residential zone. Lots 4, 5, & 611 each have about 150 feet of shoreline, <br /> while Lot 3A is only 50 feet wide. Lot 3A was previously acquired by the current <br /> property owner to add to the size of the other lots under his ownership. <br /> 7. Rezoning to Shoreline Residential would be compatible with the surrounding <br /> zoning classifications as the adjoining properties to the west and east are also <br /> Shoreline Residential and the property to the south of the road is Rural <br /> Residential. <br /> Planning Commission Minutes 4 <br /> December 14, 2006 <br />
