than one with another design. Our Ordinance discourages development of these types of <br /> properties. Rezoning and a Rural Conservation Subdivision were also discussed. <br /> A motion was made by Bill Habein, seconded by Roger Varilek,to recommend approval <br /> of the Preliminary Plat of Mayo Acres, based on the following Findings of Fact: <br /> 1. The land in the proposed development is properly zoned Forest Management as <br /> the majority of the property currently contains tree cover. The land is suitable in <br /> its natural state for the proposed development with minimum alteration. <br /> 2. The land does not contain natural features that will significantly constrain future <br /> development on the property. The land is generally flat and forested, with a <br /> portion of a wetland located in the far southeastern portion of Lot 4 of the <br /> property. <br /> 3. The property is not adjacent to public sewer, but the applicant has show that each <br /> property has sufficient room to accommodate two on-site septic treatment <br /> systems. <br /> 4. The proposed subdivision does not contain provisions for water-based recreation <br /> as non of the properties contains direct access to a public water. <br /> 5. Each of the proposed lots meets the minimum lot size of 10 acres for the Forest <br /> Management zone, with each being 10 acres in size. Each property also meets the <br /> minimum buildable lot area of 5 acres, with each having more than five acres of <br /> buildable area as the only constraining feature is located in the far southeastern <br /> corner of Lot 4 (the wetland). <br /> 6. Each of the proposed lots meets the minimum lot width of 300 feet for the Forest <br /> Management zone,with each having at least 330 feet of width. <br /> 7. The proposed lot layouts are compatible with the existing layout of surrounding <br /> properties, being similar to those on the west side of 9th Avenue SW. <br /> 8. The proposed side lot lines are at right angles with existing roads and are similar <br /> to those existing on the west side of 9th Avenue SW. <br /> 9. The Rural Residential zone is compatible with the Agriculture, Forest <br /> Management, Transitional Residential, and Recreation Zones. <br /> 10. Each lot meets the minimum requirement of 33 feet of front 2e on a public right- <br /> of-way,with each having more than 300 feet of frontage on 9 Avenue SW. <br /> 11. The applicant has Xroposed designating the western 26.5 feet of the property as <br /> right-of-way for 9 Avenue SW. The road currently does not have any right-of- <br /> way designated, and the western half of the road falls in Loon Lake Township in <br /> Cass County. <br /> 12. While the applicant has not shown any proposed future driveways, Mike Loven of <br /> the Roads and Streets department has advised that the future property owner of <br /> Lot 1 place their driveway south of the bend in the road to the north. Also, no <br /> culverts will be needed for driveways as the area is generally flat. <br /> subject to the following condition: <br /> 1.
