are assessed and Article 7 directly applies to the maintenance of property <br /> �.. within the plat. <br /> b. Article 7 requires that the Association provide for maintenance,repair, and <br /> replacement of the Common Elements including, without limitation, the <br /> open space, parks, and trails, among other items. Section 8.29 and 8.30 <br /> protect wetlands within the plat and provide restrictions on the removal of <br /> trees in the development. <br /> 3. A stormwater pollution prevention plan, based on the projected impervious <br /> coverage for the project, has been submitted to the City Engineer for review. The <br /> City Engineer has indicated that the submitted plan is satisfactory. <br /> 4. The applicant has been working with City Staff on the designs for construction of <br /> the roadways and the extension of the municipal sewer and water systems. <br /> 5. The applicant has worked with the City Attorney to draft the Developer <br /> Agreement, which contains mechanisms and securities for ensuring that the <br /> required improvements are completed. The total estimate for financial security <br /> still needs to be provided for in this document. The Staff and the applicant are <br /> meeting on Monday, October 16 to discuss these items and will provide an update <br /> on these items. <br /> 6. The City Engineer has been working with the applicant to review the proposed <br /> improvements and develop a development contract. <br /> 7. The applicant has submitted a plat check completed by an independent <br /> Professional Land Surveyor. <br /> 8. At the time of this report's preparation, the applicant was in the process of <br /> obtaining a cost estimate to be inserted into the final development agreement and <br /> to be approved by the City Engineer. <br /> 9. The Final Plat substantially agrees with the original layout in the preliminary plat. <br /> The layout of Trailside Road and the configuration of the lots in the western <br /> portion of the development has been modified slightly to fit the contour of the <br /> land and accommodate the changes in the road layout. <br /> 10. The City Attorney has agreed that all parties with an interest in the property are <br /> shown as signers of the document. <br /> 11. The City Engineer has submitted comments regarding the proposed <br /> improvements, indicating that there few remaining items that need to be addressed <br /> and a revised cost estimate provided. <br /> 12. At this time, financial security has not been posted as estimates for the required <br /> improvements are in the revision process. <br /> ROLL CALL VOTE: Mr. Habein, aye; Mr. Hallan, aye; Mr. Varilek, aye; Mr. Pederson, <br /> aye.
