All remaining members voted"aye". <br /> Motion carried. <br /> APPLICANT: City of Pequot Lakes <br /> Applicant requests an Ordinance Amendment Governing Administrative Fines and <br /> Violations. <br /> Bittner explained the Staff Report regarding the Policy and the suggestion made by the <br /> City Attorney to send a certified letter rather than have the Police Department deliver the <br /> first letter. She explained that the Police Chief recommended Police service. A certified <br /> letter may not get picked up and the Post Office would return it after 10 days. The <br /> Planning Commission discussed at length whether or not to send a letter, a certified letter <br /> or Police service. Bittner stated that this Policy and Ordinance Amendment was meant to <br /> streamline the violation process. The general consensus was: <br /> 1. First mail a letter by regular mail; <br /> 2. Have the Police Department deliver a second letter or, if the property owner does <br /> not live locally, mail a certified letter; <br /> 3. If the violation is not remedied by the specified time, have the Police Department <br /> issue a ticket. <br /> It was suggested that the fine monies could also be used to maintain parkland and educate <br /> realtors. <br /> A motion was made by Dean Williams, seconded by Scott Pederson,to forward this <br /> Policy to the City Council for approval, with Number 1 reading as follows: <br /> 1. City Staff will issue a violation letter giving the property owner a date to remedy <br /> the violation. If the violation is not remedied, a second letter will be delivered by <br /> the Police Department or mailed by certified mail if the owner does not live in the <br /> City limits. <br /> Voice Vote: 5 "aye"; 1 "nay". <br /> Ordinance Amendment: <br /> Bittner explained that the definition of Nuisance would need to be amended. She was <br /> directed to strike the word"and" in the second line. <br /> Bittner further explained that the Enforcement Section 12.1 should be replaced with the <br /> two paragraphs in bold type. The City Attorney prepared these paragraphs to cover a <br /> number of issues that have arisen over the past year.
