ROLL CALL VOTE: Mr. Habein and Mr. Williams recused themselves as they are <br /> members of Gloria Dei Lutheran Church: All remaining members voted"aye". Motion <br /> carried. <br /> (We moved to the New Business portion of the Agenda) <br /> NEW BUSINESS: <br /> a. Metes and Bounds Subdivision,Gloria Dei Lutheran Church, applicant. <br /> Ms. Barajas explained the Staff Report and recommended Finding of Fact#13 be <br /> amended as Tract A does have frontage on public right-of-way per the City Attorney's <br /> determination. <br /> There was no public comment: <br /> A motion was made by John Derksen, seconded by Roger Varilek,to approve the metes <br /> and bounds subdivision based on the following Findings of Fact: <br /> 1. The property is properly zoned Commercial and is suitable in its natural state for <br /> commercial and residential uses as permitted in the C zone, as the property has <br /> been used for residential and religious purposes. <br /> 2. There are not any significant natural features, such as steep slopes or wetlands, <br /> that would constrain future development on these properties. <br /> 3. The two structures located on this property are conforming as they meet all <br /> required setbacks and the total impervious falls under the 25%maximum allowed. <br /> 4. Each of the lots in the proposed subdivision has a separate on-site sewage <br /> treatment system. <br /> 5. Tract A is served by water services, while Tract B has an on-site well for a water <br /> supply source. <br /> 6. The applicant is not proposing any provisions for water-based recreation as these <br /> properties are not adjacent to any water bodies. <br /> 7. Both lots meet the minimum buildable lot size of 20,000 square feet in the C <br /> zone,with Tract A being 63,647 square feet and Tract B being nearly 7 acres. <br /> 8. All lots meet the minimum lot width of 50 feet, with Tract A being over 200 feet <br /> wide and Tract B being over 500 feet wide. <br /> 9. All the lots meet the impervious coverage limit of 25% for the Commercial zone, <br /> with Tract A having approximately 22% coverage with the proposed driveway <br /> included and Tract B currently having about 17% coverage. <br /> 10. The proposed lot layouts are compatible with the existing layout of adjoining <br /> properties and the proposed lot lines are parallel and perpendicular to existing lot <br /> lines. Future development will not be constrained by the proposed lot layouts. <br /> 11. The proposed side lot line is at right angles to the existing road line and the <br /> property line of the adjacent property. <br /> 12. Tract B meets the minimum frontage on public right-of-way requirement of 33 <br /> feet, having more than 500 feet. <br /> 13. Tract A does have frontage on a public right-of-way, on Olson Street to the north. <br /> Mr. Hallan directed Staff to remove the word"sanitary" from Finding of Fact#5. <br /> Planning Commission Minutes 4 <br /> March 15, 2007 <br />
