A permit is required to install the <br /> driveway and Staff will verify the location. <br /> The formula for Park Dedication that was discussed last month was used to determine the <br /> Park Dedication Fee of$4,224.00. <br /> JOHN DERKSEN ARRIVED. <br /> A motion was made by Bill Habein, seconded by Roger Varilek, to approve the Final Plat <br /> of Mayo Acres based on the following Findings of Fact: <br /> 1. The applicant has provided a covenant to be to limit access to the southern 75 feet <br /> of Lot One. <br /> 2. The Final Plat agrees with the Preliminary Plat, with no changes having been <br /> made to the lot sizes, dimensions, or layouts since Preliminary Plat approval. <br /> 3. The City Attorney agrees that all parties with an interest in the property are shown <br /> as signers of the final plat document. <br /> 4. The applicant has not proposed improvements beyond what already exists to <br /> access the property, and so completion of improvements or financial security are <br /> not required for this application. <br /> 5. The applicant has submitted a plat check, showing that an independent <br /> Professional Land Surveyor agrees that the final document meets the statutory <br /> requirements. <br /> 6. As additional improvements were not proposed or required for this property, <br /> financial security to ensure the completion of improvements was also not <br /> required. <br /> 7. The Park Board has recommended that the applicant pay a park dedication fee of <br /> $4,224.00, based upon the recent discussion and formula for calculating park <br /> dedication fees. This fee is due at the time of filing the final documents. <br /> ROLL CALL VOTE: All members voted"aye". Motion carried. <br /> APPLICANT: Gloria Dei Lutheran Church <br /> Applicant requests a Conditional Use Permit for a Single Family Home in a <br /> Commercial District. <br /> Ms. Barajas explained the Staff Report. She recommended adding a condition that the <br /> current driveway that runs between the Church and the parsonage be removed or fenced. <br /> Earl Hemmerich and Pat Trottier, Landecker and Assoc., were present representing the <br /> Church. <br /> Public comment: Mr. Hemmerich stated that the building hasn't been used as a <br /> parsonage for approximately 3 years. <br /> Staff indicated that the City has received a letter from the City Attorney's office <br /> indicating that Olson Street is public right-of-way. <br /> Planning Commission Minutes 2 <br /> March 15, 2007 <br />
