3. A deviation, with conditions limited the construction to the conditions found in
L Section 17-4.4, Subpart 4 (one-time addition) would be in keeping with the spirit
and intent of the Ordinance.
4. The proposed residential use is permitted in the Shoreline Residential zone.
5. The variance will not alter the character of the neighborhood. Adjacent properties
have homes that have OHW encroachments similar to the dwelling on this
property.
6. Reasonable use of the property has existed on the property for decades. The
Ordinance provides for reasonable use of this property.
On the construction on a non-conforming lot:
7. Strictly applying the minimum lot width requirement would prohibit any
construction on the property and thereby create an undue hardship.
8. The lot size, which was not created by the land owner, creates a situation where
strict adherence to the Ordinance would be impractical.
9. A deviation to provide for construction on a non-conforming lot would be in
keeping with the spirit and intent of the ordinance, which would be to provide for
residential construction on the property.
10. The proposed residential use is permitted in the Shoreline Residential zone.
11. The variance will not alter the character of the neighborhood. Adjacent properties
have homes that have OHW encroachments similar to the dwelling on this
property.
12. Without a variance for lot width, reasonable use of the property would not exist.
After discussion, the following conditions were added:
. The size of the addition shall not exceed fifty percent of the size of the
structure it is being added to.
2. For reasons of structural integrity, a basement may be allowed under the
addition only where a basement existed in the original structure.
3. Additional screening is provided to screen the addition as viewed from
adjacent properties, public roads and the surface water.
4. A stormwater management plan is implemented that directs stormwater
away from adjacent properties and surface waters.
5. The height of the addition shall not exceed the height of the existing
structure.
6. Beyond minor alterations needed to accommodate the addition, no
structural modifications shall be made to the original structure.
7. A formal floor plan shall be submitted indicating the dwelling does not
exceed 1,564 square feet and the elevations are not higher than existing
roofline.
8. The north side of the new garage can be no closer than 125 feet from the
OHW.
Public Comment: None.
MINUTES 4
Pequot Lakes Planning Commission
November 20, 2008
