Miller explained that if the ordinance amendment passes,they would then come back in a <br /> separate application to request approval of more,but smaller units.This would be an <br /> amendment to their Conditional use permit. <br /> Scott Pederson stated he had no problem with ensuring that the use remains transient, as there <br /> are covenants in place. <br /> Mark Hallan stated that the previous application did not max out on their allowed density. <br /> Tom Adams stated that everyone understands this would only apply to a limited number of <br /> resorts?All agreed.Adams asked if everyone understands that density would be calculated <br /> differently in this overlay zone than everywhere else.All agreed. <br /> Tom Adams made a motion to approve an ordinance amendment creating a Large Resort <br /> Overlay District which calculates allowable density based on the DNRs April 2009 Draft <br /> Shoreland Rules,as follows: <br /> 17-6.6 Large Resort Overlay Zone <br /> 1. General.The provisions of this section will apply to existing commercial resorts that are <br /> located in a Shoreline Commercial zone,were in existence prior to January 1, 2010, <br /> are part of an established Planned Unit Development and contain at least 20 <br /> dwelling units. <br /> 2. The provisions for calculating allowable density in a Planned Unit Development,found <br /> in Section 17-8.2,subpart 6(A),shall not be applicable. Instead,density shall be <br /> calculated as follows: <br /> a. Density is determined through the following steps: <br /> i. Select the appropriate ratio to determine the land surface area that can be <br /> covered by structures from the following table: <br /> Public waters classes <br /> General development lakes-first tier(Nearshore Area) 0.125 <br /> General development lakes-second tier(Lakeview Area) 0.075 <br /> Recreational development lakes-first tier(Nearshore Area) 0.075 <br /> Recreational development lakes-second tier(Lakeview Area) 0.075 <br /> GD and RD-third tier(Forestview Area) 0.075 <br /> Natural environment lakes-all tiers 0.038 <br /> All river classes 0.038 <br /> Minutes 7 <br /> Pequot Lakes Planning Commission <br /> April 20, 2010 <br />
