Tim Moore,Widseth Smith and Nolting,stated that the applicant objects to the use of garages <br /> and closet size as a proxy for transient use. Moore stated that this resort was approved with <br /> covenants requiring transient use and that these are stronger and more direct. <br /> Moore also stated that the applicant objects to the limitations on mooring slips as the City <br /> already has existing regulations regarding mooring slips and why not just use those? <br /> Moore stated that the intent of their proposal to use the density calculations in the DNR's <br /> Alternative Standards(which are also the same as being proposed as new,mandatory shoreland <br /> regulations in the DNRs 2009 draft regulations and are likely to be adopted sometime soon)as <br /> well as to match with the current market demand for smaller units.They would like to change <br /> the size of units so that they are smaller,there are more of them,but the overall number of <br /> bedrooms remains the same. <br /> Chairman Woog asked for public comments. <br /> Paul Reichenbach provided copies of the Resort web page showing that twin homes were being <br /> offered for sale with attached garages and large closets. He noted that this is all being <br /> advertised. He also asked whether clustering of the units would still be required,if the <br /> applicable lake setback is 120 feet and whether screening will be required along the shoreline. <br /> Reichenbach noted a concern that there was cutting along the shoreline previously in an illegal <br /> manner and he is concerned with that pattern and that it will only get worse. <br /> City Planner Oleson stated that the only proposed change would be to change the number of <br /> units,that all other requirements would still be in effect. <br /> Jeff Miller,Widseth Smith and Nolting,stated that the advertising of the twin homes was all in <br /> compliance with what has already been approved. He noted that the changes they are proposing <br /> to how allowable density is calculated will not result in more bedrooms on the property and <br /> explained that their proposed calculations would allow 12.5 percent building coverage in the <br /> first tier and 7.5 percent in the 2nd and 3rd tiers. Miller noted that impervious limitations will still <br /> be met,although it would likely increase slightly from what was previously presented. Miller <br /> stated that the shoreland will be left in a natural state.What they are trying to do is to re- <br /> arrange what was already approved and not open up any of the other issues, noting that garages <br /> were already approved by the City in their previous approval. <br /> Ann Beaver stated that using the 199os calculations will soon be obsolete and that more modern <br /> standards should be used. She strongly encouraged the Commission to look at the entire <br /> Alternative Shoreland Management Standards though—not just the section on how density is <br /> calculated. <br /> Scott Pederson asked the applicants if the impervious is changing. <br /> Jeff Miller stated that it may increase,but will still meet the maximum coverage allowed. <br /> Scott Pederson asked if the number of people using the site will change? <br /> Minutes 5 <br /> Pequot Lakes Planning Commission <br /> April 20, 2010 <br />
