• It could be helpful from an applicant's point but in other situations it could be <br /> �- sticky. <br /> • The Planning Commission cannot provide an answer; submit the information at <br /> the meeting and a decision will be made; <br /> • The Planning Commission cannot give an indication of the outcome when <br /> speaking with an applicant. <br /> • We don't want to create a rule for a situation that may only come up every eleven <br /> years. <br /> Commission Member Williams suggested the following: <br /> Under the Duties of the Board of Adjustment(Section 17-11.2) and Planning <br /> Commission(Section 17-11.3) of the City Code, the following could be added: <br /> "In an effort to ensure the integrity of the Board, it is the duty of the Planning <br /> Commission to encourage the public to present their comments at the time of the public <br /> hearings, either in writing or to testify in person." <br /> The public hearing is where those comments need to occur. We need to encourage them <br /> to show up at the public hearing. If they don't want to do that, they can write a letter <br /> rather than speak to the Planning Commission member. This could be an Ordinance <br /> Amendment; the City Attorney can review it after next month's meeting. <br /> b. Crow Wing County Ordinance Revisions— <br /> The Planning Commission had no comments on the County Ordinance revisions. <br /> c. Pet Day Care— <br /> Mr. Marohn explained Staff had received a request for a Pet Day Care in the Downtown <br /> Mixed Use zone. There would be no overnight boarding, only during the day. An <br /> Animal Boarding Facility houses animals overnight or for an extended period of time and <br /> would be an excluded use in the DMU. The Pet Day Care may fall under the <br /> Commercial Use, Other requiring a Conditional Use Permit. Staff is requesting <br /> interpretation from the Planning Commission. <br /> The Planning Commission discussed the Form Based Code and how best to describe this <br /> type of use. Odor and nuisance standards would all apply. It was the Planning <br /> Commissions recommendation to allow the Pet Day Care to move ahead without a CUP. <br /> OLD BUSINESS: <br /> a.
