The City does not <br /> examine plans nor assume liability for the structural stability or quality <br /> of any structures. <br /> 2. All dwelling units shall be a minimum of 20 feet wide and shall be placed <br /> on a foundation. <br /> 8. Plumbing and electrical facilities installed after the date of this ordinance <br /> in all structures shall conform to the State Plumbing Code and State <br /> Electrical Code." <br /> In addition, two storage units were moved onto the property without a Land Use Permit, <br /> as required by 17-11.8 ("(1)and use permits shall be issued for all new structures . . ."). It <br /> has come to our attention that you are living within these storage units. These storage <br /> units do not comply with the definition of a dwelling in City Code Section 17-10 (88), or <br /> the building standards in City Code Section 17-4.5• <br /> Further,the above-described conditions constitute a public nuisance under the <br /> following City Code Sections 7-2.1(1) (defining as a public nuisance any"condition <br /> which unreasonably annoys, injures, or endangers the safety, health, morals, comfort, or <br /> repose of any considerable number of members of the public") and 7-2.2(5) (defining as <br /> a public nuisance any"(a)ccumulations of manure, refuse, or other debris."). <br /> The enclosed photographs of your property from taken during the City's visual <br /> inspection from the public right-of-way demonstrate that you are in violation of the <br /> above provisions of the City Code. <br /> Rather than immediately refer this situation to the City's legal counsel for additional <br /> legal action against you,the City's preference is to work cooperatively with you and <br /> provide you an opportunity correct the above-described code violations and nuisance <br /> conditions. We are requesting that you remove all of the refuse, debris, <br /> unauthorized structures and other materials stored outside by no later than <br /> the open of business on June 13, 2016. <br /> Failure to correct the above-noted code violations by May 31, 2016 will force the City <br /> refer this matter to its legal counsel to take all appropriate legal actions, including <br /> imposing administrative fines in the amount of$1oo.00 for each day the violations <br /> continue, seeking a court order to allow the City to abate the code violations and <br /> nuisance by entering your property and removing the nuisance conditions, assessing the <br /> costs of such abatement against your property, and up to and including, in the City <br /> Attorney's discretion, initiating criminal prosecution for each documented violation of <br /> the City Code described above.
