G. The conditional use will not result in the destruction, loss or damage of a natural, <br /> scenic or historical feature of major significance. <br /> H. The conditional use will promote the prevention and control of pollution of the <br /> ground and surface waters including sedimentation and control of nutrients. <br /> Findings of Fact: Staff offers the following findings of fact for consideration of the Planning <br /> Commission: <br /> 1. The proposed use includes a storage shed with signs. This does not constitute a principle <br /> use. <br /> 2. The proposed signs are a use that would be accessory to an established principle use. <br /> 3. The proposed shed is an accessory structure. <br /> 4. With no principle structure or use, the property may not be used to display signage as <br /> proposed. <br /> 5. The proposed use is not consistent with the purpose and intent of the Commercial zone. <br /> The use proposed is advertising and storage,which are not commercial uses. <br /> 6. The use is not an appropriate conditional use in the Commercial zone as it lacks a <br /> primary use and structure. <br /> 7. The proposed use would not conform to the Comprehensive Plan. <br /> i. The proposed use does not provide the employment opportunities envisioned in <br /> the Comprehensive Plan(page 35)• <br /> ii. The proposed use would not be consistent with the character of the community, <br /> as stated in the Comprehensive Plan(page 40). <br /> 8. The use is not compatible with the existing neighborhood. This is a highway commercial <br /> property. The proposed use would not create business opportunities at this property or <br /> at increase commerce on neighboring properties within the City of Pequot Lakes. <br /> g. The conditional use will impede the orderly development of surrounding vacant <br /> properties. The establishment of this type of a use, where there is no principle use, <br /> significant investment or commercial transactions on the property, will potentially <br /> discourage others from investing in neighboring properties. <br /> io. The development of the property as proposed will increase the public cost for services. <br /> The City anticipates an increase in the commercial tax base from the ultimate <br /> development of the property. While the proposed structure would provide some <br /> increase,it is far less than that which would be provided by a functional principle use. <br /> Planning Commission Direction: The Planning Commission can recommend that the City <br /> Council approve or deny the application, or the Planning Commission can table this application <br /> for further consideration. <br /> Staff Recommendation: This application does not establish a principle use. When the <br /> applicant previously appeared in front of the Planning Commission, they indicated that they <br /> intended to sell equipment on the property in a manner similar to a car lot. This proposed use is <br /> simply an advertisement for a business not located on the property. Such a use is not in the long <br /> term interests of the other owners in this commercial area or the City of Pequot Lakes.
