a minimum of 400 square feet." <br /> Applicable Regulations: Section 3.2 of the Ordinance provides definitions of principle and <br /> accessory use as follows: <br /> Principal Structure or Use. The single primary structure or use on a lot, as <br /> distinguished from accessory uses or structure. To be considered a principle structure, <br /> the structure must be at least 400 square feet. <br /> Accessory Structure: A building or other structure that is supportive, secondary and <br /> subordinate in use and/or size to the principle structure on the same parcel or lot which, <br /> because of the nature of its use, can reasonably be located at or greater than minimum <br /> structure setbacks. Includes all structures not considered the principle structure <br /> including, but not limited to, T.V. towers antennas, dish antennas, outdoor swimming <br /> pools,outdoor hot-tubs,detached garages, sheds,guest quarters and boathouses. <br /> Section 7.1, Subdivision 5, discusses the requirements for on-site signs. The size of on-site <br /> signage is limited to io%of the principle structure fagade. <br /> As per Section 5.10, the purpose and intent of the Commercial zone is to provide a zoning <br /> classification for commercial uses oriented around the automobile. Parcels are larger than in the <br /> Downtown Mixed Use zone in order to provide on-site parking, on-site stormwater facilities, as <br /> well as on-site water supply and sewage treatment where municipal utilities are not immediately <br /> available. <br /> Since this application is a Conditional Use Permit,the CUP provisions contained in Section 11.6, <br /> Subdivision 3 also apply. Those provisions include the following: <br /> i. The following must be met: <br /> A. The use or development is an appropriate conditional use in the land use zone. <br /> B. The use or development, with conditions, conforms to the comprehensive land use <br /> plan. <br /> C. The use with conditions is compatible with the existing neighborhood. <br /> D. The use with conditions would not be injurious to the public health, safety, welfare, <br /> decency,order,comfort,convenience, appearance or prosperity of the City. <br /> 2. The following must be considered: <br /> A. The conditional use should not be injurious to the use and enjoyment of other <br /> property in the immediate vicinity for the purpose permitted on that property, nor <br /> substantially diminish or impair values in the immediate vicinity. <br /> B. The conditional use will not impede the normal and orderly development and <br /> improvement of surrounding vacant property for uses predominant in the area. <br /> C. The conditional requirements at public cost for public facilities and services and will <br /> not be detrimental to the economic welfare of the community. <br /> D. The conditional use will have vehicular approaches to the property which are so <br /> designed as not to create traffic congestion or an interference with traffic on <br /> surrounding public thoroughfares. <br /> E. Adequate measures have been taken to provide sufficient off-street parking and <br /> loading space to serve the proposed use. <br /> F. Adequate measures have been taken or will be taken to prevent or control offensive <br /> odor, fumes, dust, noise, and vibration, so none of these will constitute a nuisance <br /> and to control lights and signs in such a manner, that no disturbance to neighboring <br /> properties will result. <br /> City of Pequot Lakes Staff Report 4 <br /> March,2008 <br />
