The City Code states in Section 17-11.8 (1)that "Land Use Permits shall be issued for all new structures. . . No person shall. . . construct any structure prior to applying for and receiving a Land Use Permit. " I have taken the enclosed pictures from adjacent property. If these pictures accurately depict your property, I would have to find that you are in violation of this provision of the City Code. I have enclosed a Land Use Permit Application form. Please complete the application and return no later than May 29,2009,including all items highlighted on page 1. The after-the-fact fee will be determined by the Planning Commission after receiving the application and supporting information. Failure to make application by May 29,2009 will prompt us to take more aggressive action. This would likely include Administrative Fines in the amount of$100.00 per day for each day the violation continues, civil action to obtain a court order directing you to comply with the City Code and could potentially include criminal action.
