and against any expenses, claims, damages, losses or other liabilities, including without <br /> limitation attorneys' fees and costs of litigation, arising out of (i) any alteration which <br /> violates any governmental laws, codes, ordinances or regulations, (ii) the adequacy of <br /> the specifications for construction of the alterations, and (iii) the construction of the <br /> alterations. <br /> SECTION 9 <br /> MAINTENANCE <br /> 9.1 Maintenance by Association. The Association shall provide for all <br /> maintenance, repair or replacement (collectively referred to as "maintenance") of the <br /> Common Elements, including all improvements thereon. In addition, for the purpose of <br /> preserving the architectural character, quality, and uniform and high standards for <br /> appearance of the Property, the Association shall provide for exterior maintenance upon <br /> the Units as follows: <br /> a. provide for lawn, shrub and tree maintenance on the yard areas of all <br /> Units, as originally installed, and watering of lawns; <br /> b. All structural repair to Units shall be separately assessed and are not <br /> considered to be general maintenance. <br /> The Association's obligation to maintain exterior building surfaces shall exclude <br /> foundations and foundation walls, Dwelling walls, floors, ceilings, all interior parts of the <br /> Dwellings, door hardware, mechanical, electrical and plumbing systems, and any other <br /> items not specifically required to be maintained by the Association, unless otherwise <br /> approved under Section 9.2. The Association shall have easements as described in <br /> Section 13 to perform its obligations under this Section 9. <br /> 9.2 Optional Maintenance by Association. In addition to the maintenance <br /> described in Section 9.1, the Association may, with the approval of a majority of votes <br /> cast in person or by proxy at a meeting called for such purposes, undertake to provide <br /> additional exterior maintenance to the Units, or maintenance of water and sewer <br /> systems within the Units. <br /> 9.3 Maintenance by Owner. Except for the exterior maintenance required to <br /> be provided by the Association under Section 9.1 or 9.2, all maintenance of the Units <br /> shall be the sole responsibility and expense of the Owners thereof. The Limited <br /> Common Elements allocated to a Unit shall be maintained by the Owner of that Unit. <br /> However, the Owners and Occupants shall have a duty to promptly notify the <br /> Association of defects in or damage to those parts of the Property which the Association <br /> is obligated to maintain. The Association may require that any maintenance to be <br /> performed by the Owner be accomplished pursuant to specific uniform criteria <br /> established by the Association. The Association may also undertake any maintenance <br /> that the responsible Owner fails to or improperly performs, and charge and assess the <br /> Unit for the cost thereof. Such cost shall be a personal obligation of the Owner and a <br /> lien against the Owner's Unit. -� <br /> 16 <br />
