trimming, or other maintenance on the Common Elements for purposes of maintaining <br /> the appearance of the Property. <br /> 10. Access to Units. In case of emergency, all Units are subject to entry, <br /> without notice, by an officer or Member of the board, or by any public safety personnel. <br /> ARTICLE X <br /> MAINTENANCE <br /> The maintenance of the Property shall be subject to the following requirements: <br /> 1. Association's Obligations. The Association shall be obligated to maintain <br /> the Common Elements and the Limited Common Elements. The Association may elect <br /> to maintain other parts of the Property, by a unanimous vote of those Members entitled <br /> to vote. The Association shall fund its costs of maintenance by Common Expense <br /> assessments levied against the memberships. <br /> 2. Member's Obligations. The Members shall be obligated to maintain, at <br /> their expense, all their Units and utilities serving their Units. The Members shall also <br /> maintain any other parts of their Units,which are not required to be maintained by the <br /> Association. The Members shall maintain their Units in good, clean and sanitary <br /> condition and repair, in compliance with standards imposed by the Association and in <br /> compliance with all applicable governmental laws, codes, ordinances and regulations. --1 <br /> ARTICLE XI <br /> REMEDIES <br /> 1. Legal Actions. The Association shall have a cause of action against any <br /> Member who violates, or whose employees, customers or clients violate the Governing <br /> Documents or the Act. The Association's legal rights shall include, without limitation, <br /> the right to commence an action for money due, for damages or for injunctive relief, and <br /> the right to foreclose its lien against a membership. The Association may impose late <br /> charges for the late payment of Common Expense assessments, may levy fines against <br /> Members for violations of the Governing Documents, and may enter any Unit to correct <br /> any condition in the Unit that violates the Governing Documents or any applicable <br /> governmental laws, codes or regulations. <br /> 2. Expenses. All expenses incurred by the Association in such enforcement <br /> or collection procedures, including without limitation all attorney's fees and court costs <br /> incurred, shall constitute a lien against the membership of the Member against whom <br /> the proceedings are undertaken. The Association's assessment lien against the <br /> membership shall be foreclosed in the same manner as a security lien under the <br /> Minnesota Uniform Commercial Code. The redemption amount shall include, in <br /> addition to the principal amount of the obligation, all expenses and fees, of any type <br /> whatsoever, incurred by the Association in connection with the foreclosure of the lien. <br /> The foreclosure of the Association's lien, where the Member fails to redeem within the <br /> ^1 <br /> 12 <br />
