The Declaration needs to include language indicating how assessments will be -AN <br /> paid, if there are any in the future. <br /> 3. The utility easement across the north property needs to be reviewed by the City <br /> Attorney. If additional easements are required on this property to ensure the <br /> long-term viability of the utility systems serving this property, such easement <br /> shall be granted as part of the final plat. <br /> 4. As part of the final platting process, the applicant shall indicate how the <br /> landscaping between the public road and the building will be improved (it is <br /> currently not improved or intensively maintained). The applicant shall also <br /> indicate how,once improved,the common grounds are to be maintained. <br /> 5. The association documents shall establish how interior walls are to be managed <br /> and maintained. <br /> 6. The association documents shall indicate how signage rights within the common <br /> area are to be allocated. <br /> Section 11.9, Subdivision 6C outlines the procedure to follow when reviewing a final plat <br /> application and directs the Planning Commission to consider the following: <br /> i. Has the applicant complied with all conditions and requirements upon which the <br /> preliminary approval is expressly conditioned wither through performance or <br /> execution of appropriate agreements assuring performance? <br /> 2. Does the Final Plat or Final Condominium Plat agree with the Preliminary Plat or <br /> Preliminary Condominium Plat? <br /> 3. Does the City Attorney agree that all parties with an interest in the property are <br /> shown as signers of the document? <br /> 4. Does the City Engineer agree that all improvements required are satisfactorily <br /> completed or are guaranteed by contract with adequate financial security? --� <br /> 5. Does an independent Professional Land Surveyor agree that the final document <br /> meets the statutory requirements? <br /> 6. Has financial security been posted in the appropriate amount? <br /> Staff Findings: The Staff provides the following findings of fact for consideration: <br /> 1. The applicant has complied with all but one condition of preliminary plat <br /> approval. <br /> a. Section 20 of the Declaration indicates that the Association is responsible <br /> for the sanitary sewer connection and resolution of any disagreements <br /> over the connection. <br /> b. Section 20 of the Declaration indicates that the Association is responsible <br /> for assessments made to the property. <br /> c. The City Attorney has not indicated that any further easements are <br /> necessary. <br /> d. The applicant has submitted a landscaping plan for improvements <br /> between the public road and the building.The Association Bylaws indicate <br /> that the Association is responsible for maintenance of the common space. <br /> e. Section 3 of the Declaration indicates how common walls are to be <br /> managed and maintained. <br /> f. Article IX of the Association Bylaws indicate that the Association is <br /> responsible for signage on the property. --� <br /> 2.
