Mr. Marohn explained a Design Review Team (DRT)meeting was held with the <br /> applicant, a few Planning Commission members, the public and staff and worked out a <br /> lot of the issues. The major issue left on the table wanting more exploration was the <br /> clearing of vegetation. A site visit was held tonight at 5:00. Applicant Tom Steffens was <br /> present, as well as Jeff Miller, WSN. <br /> The conditions include an updated vegetation plan and Mr. Marohn added a mandatory <br /> site visit by the DRT on page 5 (a) -6. The Code allows for clearing of trees 4 inches or <br /> less. The Code also talks about screening and visibility from the lake. He further <br /> explained that the DRT,the Planning Commission and the public are struggling with the <br /> notion that we could allow development in a manner consistent with the 4 inch rule <br /> mentioned above as a simple way to administer the code. It would also be simple and <br /> easy for the Planning Commission to say no cutting at all, no limbing or brushing. Both <br /> scenarios people like. The DRT discussed a site visit before tree removal or trimming. <br /> PUBLIC COMMENT: <br /> Ann Beaver, 26834 Pine Acres Road,Nisswa, representing Cullen Lakes Association— <br /> Either of those two scenarios are unsatisfactory. On behalf of the Lake Association they <br /> support the Planning Commission having over site of what gets cut and when so it <br /> doesn't just happen. The City is the governing force here. <br /> Page 5 (a)-4, #30: Mrs. Beaver further stated the agreement designates that bluff area is <br /> restricted. Mr. Marohn stated it would remain restricted and continue it over to a new <br /> document. <br /> #36: Mrs. Beaver also stated that the second beach is dropped later from the conditions. <br /> She would like to add only the--allow ed beach is located in the southern part of the <br /> western edge. She would like assurance that second beach and picnic area is not allowed. <br /> #39: Mrs. Beaver asked whether the vegetation enhancement plan has been acted upon <br /> since its 2008 approval. Mr. Marohn stated that is has and this CUP will require a new <br /> one. <br /> Mrs. Beaver asked if the conditions included a rental requirement for units that are <br /> privately owned. Mr. Marohn stated the City does not have one with the developer <br /> because it was residential density. Now that it is commercial density we should need that <br /> requirement. <br /> Mrs. Beaver further asked if there has been a specified implementation schedule. Mr. <br /> Marohn stated that there is no calendar schedule but it is tied to when the units are <br /> developed.
