Co�vr�vrurz 'Y' c��°� <br /> cwR.oNv7rH Peq�ot <br /> INSTITUTES. <br /> STAFF REPORT <br /> Application: Ordinance Amendment to create a Large Resort Overlay District <br /> Applicant: Wilderness Resort Villas, LLC <br /> Agenda Item:4(c) <br /> Background Information: Wilderness Resort has requested an amendment to the <br /> Code that would provide a mechanism for them to convert units within their plat from <br /> single to duplex. This will involve an amendment to their CUP and a re-platting of the <br /> resort. It would also require a change in the density provisions, which is what this <br /> amendment is designed to address. <br /> When Wilderness Resort was platted in its current form, we were in the process of <br /> updating the City Code. The Planning Commission had lengthy discussions on how to <br /> handle density in the context of units that were to be sold individually and put back into <br /> a rental pool. The overriding concern was to avoid a situation where generous density <br /> allowances were allowed due to the commercial nature of the property, only to have the <br /> individual owners than convert those properties to residential usage. <br /> The way this was handled was to limit the density to the base density for residential <br /> development. In essence, the added density allowances for commercial properties were <br /> removed from the Pequot Lakes Code. <br /> The proposed amendment would restore those allowances through an overlay district <br /> that would apply to a limited subset of properties. To maintain the spirit of the original <br /> discussion, we have included language that seeks to ensure that the design of the <br /> dwelling units remains transient. We also added language concerning mooring spaces, <br /> ensuring that the residential density calculations would still apply where it was the <br /> limiting number. <br /> Planning Commission Direction: The Planning Commission can recommend that <br /> the City Council approve the amendment. The Planning Commission can also <br /> recommend that the amendment not be approved. The Planning commission can also <br /> choose to table the amendment for further modification or discussion.
