A dirt moving permit is not required if a wetland replacement <br /> plan,exemption or no-loss has been approved pursuant to 8420. This dirt moving activi <br /> does not apply towards the cumulative amount prescribed in 28.5 F of this article. <br /> M. Retaining walls 18 inches in height or less. Retaining walls 18 inches in height or less are <br /> considered a special structure and are not regulated in this article. <br /> N. Stump removal. A project that does not require a dirt moving permit from the Land <br /> Services Department may require additional permits or approval from local, state or federal <br /> agencies and is the responsibility of the landowner to obtain the proper approval and permits. <br /> 28.3 STANDARD OF REVIEW FOR ACTIVITIES NEAR WETLANDS <br /> The dredging e€-af}wWetlands are as defined by the United States Army <br /> Corp of Engineers Wetland Delineation Manual(January 1987) <br /> Wetlands including updates, supplements and clarification memoranda and this ordinance. shall <br /> be reviewed by4he Planfling <br /> Jr the Meseta-State Rules Qhgpte and as eudined in the <br /> Wetland Gensefv t.e., ^et of 1991. For any activity that will impact a wetland,the"Minnesota <br /> Local/State/Federal Application Forms for Water/Wetland Projects"must be submitted to the <br /> Land Services Department. Crew Wing SWCD The Land Services Department shall may submit <br /> copies of the application to any local Watershed Management Organization,the Board of Water <br /> and Soil Resources,the Minnesota Department of Natural Resources(DNR)and United States <br /> Army Corps of engineers(USACE)as required by the Alefland Gensefvafien "e'Minnesota <br /> Rules Chapter 8420 prior to issuing a permit. <br /> 28.4 STANDARDS FOR DIRT MOVING ACTIVITIES IN SHORELAND AREAS <br /> The guidelines that direct dirt moving in the Shoreland areas are set up to allow greater quantities <br /> of dirt moving as the distance from the receiving water increases. For the purposes of these <br /> standards,three zones are recognized within the Shoreland management area,they are: shore <br /> impact zone(SIZ); construction impact zone(CIZ); and rear-lot zone(RLZ). <br /> A. ACTIVITIES IN THE SHORE IMPACT ZONE(SIZ): <br /> The following standards shall apply to activities regulated under this section when they are <br /> proposed for the shore impact zone(SIZ): <br /> i. Definition of SIZ. The area designated as the SIZ is a distance from the ordinary high <br /> water level(OHWL)to half the distance of the conforming building setback. <br />
