(c) Notwithstanding paragraph (b), any electronic mail address or telephone <br /> number provided by a public body for use by an appointee shall be public. An <br /> appointee may use an electronic mail address or telephone number provided <br /> by the public body as the designated electronic mail address or telephone <br /> number at which the appointee can be reached. <br /> The League goes on to indicate that the data practices act makes residential address and a <br /> telephone or email public information.Any policy the City might adopt cannot contradict this <br /> law. The City Attorney can assist in determining what provisions would be relevant to <br /> consider in adopting a policy. They also advise that the City would need to carefully consider <br /> what penalty it may impose if a person violates the policy. <br /> Planning Commission Action: Staff began preparing a draft policy that was very detailed. <br /> After receiving the comments above, Staff is requesting direction from the Planning <br /> Commission how they wish to proceed. The City Attorney has not yet been contacted for his <br /> advice. <br /> The correspondence from Community Growth Institute and The League of Minnesota Cities <br /> is attached for your review. <br />
